أنا صاحب مكتب عقارات جاءني صاحب بيت يريد البيع أي عرضه على المكتب لإيجاد مشتري على أنه أي صاحب الملك قال لي حرفيا أحضر لي ثمن 150ألف وشوف أمورك.
وبعد فترة وجدت فيه أنا ووسيط آخر ثمن 180ألف وأخبرته بأن الوسيط الثاني يريد الفرق وهو30ألف ووافق على ذلك وبعد أن استلم المبلغ لم يوف بعهده فهل هذا حرام أم حلال؟]ـ
الزيادة على الثمن المحدد هل يتملكها السمسار
إنما قمت به أنت والوسيط الذي دل على المشتري يعتبر من أعمال السمسرة وهي: البحث للبائع عن من يشتري سلعته، والبحث للمشتري عن من يبيع له حاجته والوساطة بينهما وتسهيل العملية.. وهي جائزة على الراجح من أقوال العلماء، قال ابن عباس: لا بأس أن يقول: بع هذا الثوب فما زاد على كذا وكذا فهو لك. رواه البخاري تعليقا ووصله غيره.
وعلى هذا، فإذا كنت قد اتفقت مع البائع على أن تبيع البيت بكذا وما زاد على ذلك فهو لك، ثم قمت أنت أو صاحبك بترويج البيت حتى بيع بالثمن الذي ذكرت، فإن الزيادة على الثمن الذي حدد مالك البيت لكما.
ولا يجوز لصاحب البيت نقض العهد والرجوع عن كلامه الأول وإهدار جهدكما، وقد قال الله تعالى: وَأَوْفُوا بِالْعَهْدِ إِنَّ الْعَهْدَ كَانَ مَسْؤُولاً [الإسراء:34] .
وقد قال النبي صلى الله عليه وسلم: آية المنافق ثلاث: إذا حدث كذب، وإذا وعد أخلف، وإذا ائتمن خان. رواه البخاري ومسلم.
