تقول هي امرأة متزوجة من رجل وقد أنجبت منه أربعة أولاد، ولكنه يسيء معاملتها وأولادها ولا يوفر لهم ما يحتاجون إليه، ومع ذلك يمنعها من أن تأخذ شيئا من أهلها كطعام ونحوه، ويمنعها أن تشتري لهم ما يحتاجون، فلا هو يصرف عليهم ويلبي طلباتهم ولا هو يقبل أن تستعين بنفسها أو بأهلها حتى في الضروريات، فكيف تتصرف مع هذا؟ وهل يجوز لها البقاء معه على تلك الحالة؟
الجواب: تصرفات زوجها معها ومع أولادها بكونه يقصر في نفقتهم ويمنعها من أن تأتي بما يكملها من نفسها أو من أهلها. نقول: إذا كان لا يمكنها أن تأخذ من ماله ولو بغير علمه للإنفاق على نفسها وأولادها فإنه لا حرج عليها أن تأخذ من أهلها ما تنفق به على نفسها وأولادها، ولو منعها من ذلك فإنه ظالم، وهو ظالم حيث يمنعها من النفقة الواجبة عليه إن صح ما تقول في هذا الرجل. أما البقاء معه أو طلب الفراق. فإذا كانت ترجو في البقاء معه أن يصلح الله حاله بالنصح والإرشاد فإنها تبقى معه؛ لئلا ينفرط سلك العائلة وتحصل مشاكلات بينها وبينه ويحصل القلق لأولادها، وإذا كانت لا ترجو ذلك فإنها تستخير الله عز وجل وتشاور من تراه ذا عقل راجح في هذه المسألة هل تبقى أو تفارق؟ ونسأل الله أن يختار لها ما فيه الخير والصلاح، والله أعلم.
