الحصول على الحق
هل لي الحق في أن آخذ حقي من دون علم من أعمل عنده؟
أنت تعمل في مكان، ولك عند صاحب المكان حق، وصاحب الحق لا يعطيك، هل يجوز أن تأخذ حقك دون أن يدري؟
هذا السؤال كثيراً ما يرد،
والحقيقة أنك تتوهم أن حقك ثابت؟
هل صاحب المحل معترف به ويقول لك: عندي لك حق ولن أعطيك إياه.
يوجد حالات نادرة جداً،
إذا كان الحق ثابتاً، ثبوتاً واضحاً كالشمس، والذي عليه الحق اعترف به، وقال: لن أدفعه لك.
هنا: لو وصل إلى يديك مال له، وكان حقك ثابتاً ومعترفاً به فليس هناك منازعة، يجوز في هذه الحالة النادرة جداً أن تأخذ حقك،
أما أغلب الظن
يكون هناك خلاف على السعر، لما قال لك بخمسين، قلت لا بثلاثين، لم يوافق، أنت سجلتها بثلاثين، فحسب رقم دفترك لك عنده حق، ولم يقرك على ذلك، لم يوجد إيجاب وقبول،
لا بد من شرط البيع أن يتوافق الإيجاب والقبول في مجلس العقد، لم يتم الإيجاب والقبول على مبلغ ثابت، فحقك ليس ثابتاً، أنت تتوهم أنه ثابت، على كل حال مثل هذه الفتوى خطيرة جداً،
لو سمحنا لمن توهم أنه له حق عند الآخرين، ولما وصل إلى يده بعض من أموالهم، هذا ما توهمه حقاً، تكن فتنة في الأرض وفساد كبير.
أما إذا كان الحق ثابتاً، منصوصاً عليه، وقد اعترف الطرف الآخر به، قال لك: لك عندي هذا المبلغ، لكن لن أعطيك إياه، أنت والمحاكم.
ثم جاء من يعطيك له مبلغاً، وظن بأنك صديقه، وصل إليك مالك في مثل هذه الحالة التي لا تقع في مثل هذه الحالة إلا مرة واحدة، لك أن تأخذ حقك.
قال أحد الأخوة: أنه تاجر مفروشات، يوجد شخص اشترى منه منذ سنتين أو ثلاثة بضاعة ولم يدفع ثمنها، لكن يأتيه كل مرة ويشتري منه البضاعة نقداً، والدين ثابت، الدين ثابت معترف به ولكن لا يعطيه إياه، أما كل شيء جديد يدفع ثمنه نقداً، قال: رسمت خطة، يدخل ويختار من البضاعة ما يعجبه يضعها على ظهر الشاحنة ويأتي ليدفع ثمنها، والدين القديم ثابت،
قال: شغلته بضيافة، وأوحيت إلى العمال أن يعيدوا البضاعة دون أن يشعر، ودفع لي ثمن البضاعة، وقام ليركب السيارة، قال له: البضاعة أصبحت في محلي، ثمن قديم قد استردته الآن.
طبعاً في مثل هذه الحالة لا يوجد مانع، إن كان الدين ثابت معترف به، لا يوجد إشكال، لا يوجد شك، والمدين يريد أن لا يدفع لك الدين، واسترددت حقك بطريقة أو بأخرى، لا شيء عليك.
