السؤال: ما الفرق بين الرشوة والهبة؟
الفرق بين الرشوة والهبة
الجواب:
الرشوة هي ما يدفعه الإنسان ليأخذ ما ليس من حقه، أو ليتهرب بها من حق عليه.

وقال ابن عابدين في "حاشيته" (5/362):
"الرِّشْوَةُ مَا يُعْطِيهِ الشَّخْصُ الْحَاكِمَ وَغَيْرَهُ لِيَحْكُمَ لَهُ، أَوْ يَحْمِلَهُ عَلَى مَا يُرِيدُ" انتهى.
ذكر ابن عابدين رحمه الله في حاشيته: (أن الرشوة هي: ما يعطيه الشخص لحاكم أو غيره ليحكم له أو يحمله على ما يريد)، وواضح من هذا التعريف أن الرشوة أعم من أن تكون مالا أو منفعة يمكنه منها، أو يقضيها له.
والمراد بالحاكم: القاضي، وغيره: كل من يرجى عنده قضاء مصلحة الراشي، سواء كان من ولاة الدولة وموظفيها أو القائمين بأعمال خاصة كوكلاء التجار والشركات وأصحاب العقارات ونحوهم.
والمراد بالحكم للراشي، وحمل المرتشي على ما يريده الراشي: تحقيق رغبة الراشي ومقصده، سواء كان ذلك حقا أو باطلا.
وإذا كان الإنسان لا يستطيع الوصول إلى حقه إلا بدفع الرشوة، جاز له بذلها لمن يوصل إليه حقه، ويكون ذلك حراما على الآخذ فقط، دون المعطي.
أما الهبة:
فهي دفع مال لمن ينتفع به على سبيل التمليك بلا عوض.

وهي بمعنى الهدية، وقد يكون الباعث عليها: محبة الموهوب له، أو إرادة إكرامه، أو التودد إليه، أو الصدقة عليه، أو مكافأة له على إحسانه.
فليس المقصود من الهدية أو الهبة أخذ ما ليس من حقه، وبهذا يظهر الفرق بين الرشوة والهبة.
الهبة مستحبة، وهي مشتقة من هبوب الريح، يقال: هبت الريح؛ وذلك لأن الريح خفيفة وهبوبها خفيف، ثم سميت الهبة بذلك لخفتها على مال الواهب. ويعرِّفون الهبة بأنها: تمليك عين بلا عوض، وتسمى هبة التبرع أو التبرر، وهو الذي لا يريد عليها عوضاً، وإنما يقصد بذلك التودد إلى الذي يهب له، ويقصد أن تحصل بينهما المودة والمحبة وصفاء القلوب.
وكان النبي صلى الله عليه وسلم يقبل الهدية ويُثيب عليها، وكان يأكل من الهدية ولا يأكل من الصدقات والزكوات ونحوها، ويقول: (إنها لا تحل لآل محمد)، أما الهدية فإنه كان يقبلها ويثيب عليها "
