السلام عليكم
هل يجوز لإمرأة لا تقوى على الصيام
أن تدفع كفارة (فدية) شهر رمضان قبل بدايته؛ لتشارك بسلل غذائية لمحتاجين؟؟؟
هل يجوز ....؟؟
كثيراً، ما يسألوننا، لأن بعض الناس ليس لديها استطاعة أن تدفع الآن صدقة، ثم (فدية) كفارة صيام، أو فطرة رمضان.
بماذا أجيبهم ؟؟
لو سمحت ممكن من حضرتك فتوى كاملة بهذا الخصوص.
الجواب:
في زمن الإلحاح الشديد والحاجة الملحة؛ (الوباء، الجائحة؛ كورونا)
يجب تقديم الخيرات ولو في غير زمان وجوبها (شهر رمضان)
الفريضة والخير والحسنة في ذاتها (فدية الصيام، زكاة المال) تتفاوت بحسب حاجة المحتاج، كما أنها تتفاوت بتفاوت الزمان والمكان.
فإذا اجتمع فضيلة الوقت (رمضان) مع حاجة الفقير؛ فإن حاجة الفقير تقدَّم.
كما كان رسول الله صلى الله عليه وسلم يستعجل زكاة مال عمه العباس رضي الله عنه.
إذا وجبت على الإنسان (زكاة، فدية صيام، كفارة، صدقة الفطر)،
وقُدِّر أن الناس قد أصيبوا بمسغبة (حاجة شديدة، لا أعمال، لا أجور، ارتفاع أسعار، وباء، جائحة، كورونا)، قبل حلول زمن وجوب أداء العبادة المالية (حولان الحول، وجوب الفدية، وجوب زكاة الفطر) في رمضان، وهو وقت فاضل، وهو محل للزكاة والصدقة والفدية، وصدقة (زكاة) الفطر؛
وقد اشتدت حاجة الفقراء قبل رمضان بسبب الجائحة (كورونا)
فالأفضل أن نبادر بالواجبات الشرعية، وأن ندفع (نسد) حاجة الفقراء والمساكين.
يقول الله تعالى: {أَوْ إِطْعَامٌ فِي يَوْمٍ ذِي مَسْغَبَةٍ} [البلد: 14].
والقاعدة الفقهية تقول: إذا اجتمع في العبادة فضيلة تتعلق بمكانها أو زمانها أو في نفس العبادة؛ فالأولى بالمراعاة ما يتعلق بنفس العبادة، وهو إيصال المال لسد حاجة الفقير زمن الشدائد.
