مطلب: تعريف الحج:

مطلب: الحكم التكليفي للحج:

مطلب: وجوب الحج على الفور أو التراخي:

اختلفوا في وجوب الحج عند تحقق الشروط هل هو على الفور أو على التراخي؟.

ذهب أبو حنيفة وأبو يوسف ومالك في الراجح عنه وأحمد^{(^[1])} إلى أنه: يجب على الفور، فمن تحقق فرض الحج عليه في عامٍ فأخره يكون آثماً، وإذا أداه بعد ذلك كان أداءً لا قضاء، وارتفع الإثم.

وذهب الشافعي والإمام محمد بن الحسن إلى أنه^{(^[2])}: يجب على التراخي؛ فلا يأثم المستطيع بتأخيره.

استدل جمهور الفقهاء على الوجوب الفوري بالآتي:

أ - الحديث: "مَنْ مَلَكَ زَادًا وَرَاحِلَةً تُبَلِّغُهُ إِلَى بَيْتِ اللَّهِ، وَلَمْ يَحُجَّ؛ فَلاَ عَلَيْهِ أَنْ يَمُوتَ يَهُودِيًّا أَوْ نَصْرَانِيًّا"^{(^[3])}.

ب - المعقول: وذلك أن الاحتياط في أداء الفرائض واجب، ولو أخَّر الحج عن السنة الأولى فقد يمتد به العمر، وقد يموت فيفوت الفرض، وتفويت الفرض حرام، فيجب الحج على الفور احتياطاً.

واستدل الشافعية ومن معهم بما يلي^{(^[4])}:

أ - أن الأمر بالحج في قوله تعالى: {وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ} [آل عمران: 97] مطلق عن تعيين الوقت، فيصح أداؤه في أي وقت، فلا يثبت الإلزام بالفور؛ لأن هذا تقييد للنص، ولا يجوز تقييده إلا بدليل، ولا دليل على ذلك.

ب - أن النبي صلى الله عليه وسلم فتح مكة عام ثمان من الهجرة، ولم يحج إلا في السنة العاشرة، ولو كان واجباً على الفورية لم يتخلف رسول الله صلى الله عليه وسلم عن فرض عليه.
