764 شروط الاستطاعة العامة للرجال والنساء 2 12 1442 12 7 2021 الباب السابع: الحج مطلب: تعريف الحج. مطلب: الحكم التكليفي للحج. مطلب: وجوب الحج على الفور أو التراخي. مطلب: شروط فرضية الحج: البلوغ. الاستطاعة: القسم الأول: شروط عامة للرجال والنساء: شروط الاستطاعة العامة أربع خصال: القدرة على الزاد، وآلة الركوب (وسائل النقل)، وصحة البدن، وأمن الطريق، وإمكان السير. الخصلة الأولى([1]): تشترط لوجوب الحج القدرة على الزاد وآلة الركوب (وسائل النقل)، والنفقة ذهاباً وإياباً. والزاد الذي يشترط ملكه هو ما يحتاج إليه في ذهابه وإيابه من مأكول، ومشروب، وكسوة، بنفقة وسط؛ لا إسراف فيها ولا تقتير([2]). وصرح الفقهاء بأنه يشترط في الراحلة أن تكون مما يصلح لمثله؛ إما بشراء، أو بكراء([3])، وإن تَقَدُّم الحضارة ألغى استعمال الدواب في الأسفار وأحل مكانها السيارات والطائرات والبواخر. وبناء على هذه القاعدة التي قرروها نقول: مَن ملك نفقة وسيلة للسفر لا تناسبه لا يكون مستطيعاً للحج حتى يتوفر لديه أجر وسيلة سفر تناسب أمثاله، بناء على مذهب جمهور الفقهاء. الخصلة الثانية للاستطاعة: صحة البدن([4]): إن سلامة البدن من الأمراض والعاهات التي تعوق عن الحج شرط لوجوب الحج. فلو وجدت سائر شروط وجوب الحج في شخص وهو مريض زَمِن، أو مصاب بعاهة دائمة، أو مقعد، أو شيخ كبير لا يثبت على آلة الركوب (وسائل النقل) بنفسه، فلا يجب عليه أن يؤدي بنفسه فريضة الحج اتفاقاً. الخصلة الثالثة: أمن الطريق([5]): أمن الطريق يشمل الأمن على النفس وعلى المال، وذلك وقت خروج الناس للحج؛ لأن الاستطاعة لا تثبت دونه. ويُعبر عن ذلك اليوم بتأشيرة (سمة) الدخول (الفيزا). الخصلة الرابعة: إمكان السير: إمكان السير أن تَكْمُل شرائط الحج في المكلف، والوقتُ متسعٌ يُمْكِنُه الذهاب للحج. وهذا شرط لأصل الوجوب عند الحنفية والمالكية والشافعية، وشرط للأداء عند الحنابلة([6]). وعبر الحنفية عن هذا الشرط بالوقت، وأن ذلك بمنزلة دخول وقت الوجوب؛ كدخول وقت الصلاة، فإنها لا تجب قبل وقتها([7]).     ([1]) الهداية، المرغيناني مع فتح القدير 2/127، رَدُّ المحتار على الدُّر المختار (حاشية ابن عابدين)2/195، وحاشية الباجوري 1/526، ونهاية المحتاج، الرملي 2/377، والمغني، ابن قدامة 3/221.
