وبهذا يعلم أن اجتهادات أئمة المذاهب جزاهم الله خيراً لا يمكن أن تمثل كلها (شرع الله المنزل على رسوله وإن كان يجوز أو يجب العمل بأحدها، والحق أن أكثرها مسائل اجتهادية وآراء ظنية تحترم وتقدر على السواء، ولا يصح أن تكون ذريعة للعصبية والعداوة والفرقة الممقوتة بين المسلمين الموصوفين في قرآنهم بأنهم إخوة، والمأمورين بالاتفاق والاعتصام بحبل الله.
وقد كان المجتهد من الصحابة يتحاشى أن يسمى اجتهاده: حكم الله أو شرع الله، وإنما كان يقول: هذا رأيي، فإن كان صواباً فمن الله، وإن كان خطأ فمني ومن الشيطان، والله ورسوله منه بريء. وكان مما يوصي به النبي أمير الجيش أو السرية قوله: "وَإِذَا حَاصَرْت حِصْنًا فَسَأَلُوك أَنْ تُنْزِلَهُمْ عَلَى حُكْمِ اللَّهِ وَرَسُولِهِ فَلَا تُنْزِلْهُمْ عَلَى حُكْمِ اللَّهِ وَرَسُولِهِ؛ فَإِنَّك لَا تَدْرِي أَتُصِيبُ حُكْمَ اللَّهِ فِيهِمْ أَمْ لَا، وَلَكِنْ أَنْزِلْهُمْ عَلَى حُكْمِك وَحُكْمِ أَصْحَابِك"([1] ) .
وهو يدل على أن الأصح في قضية الإصابة والخطأ في الاجتهاد في الفروع الفقهية، هو مذهب المخطئة، وهم جمهور المسلمين، منهم الشافعية، والحنفية على التحقيق، الذين يقولون بأن المصيب في اجتهاده واحد من المجتهدين، وغيره مخطئ؛ لأن الحق لايتعدد. ويقولون: إن الله تعالى في كل واقعة حكماً معيناً، فمن أصابه فهو المصيب، ومن أخطأه فهو المخطئ. لكن بالنظر إلى العمل بثمرة الاجتهاد، لا شك أن حكم كل مجتهد هو حكم الله، لتعذر معرفته بيقين.
وأخيراً تظل عقدة المسلمين الجاثمة فيهم في عصرنا هي العمل بشريعتهم؛ عقيدة وعبادة والتزاماً وتطبيقاً لأحكام الإسلام في العبادات والمعاملات والجنايات والعلاقات الخارجية على حد سواء.
