كفارات محظورات الإحرام.
كفارات محظورات الترفه:
ويتناول كفارة محظورات اللُّبْسِ، وتغطية الرأس، والادهان، والتطيب، وحلق الشعر أو إزالة قطعة من شعر الرأس أو غيره، وَقَلْمِ الظُّفُرِ.
أصل كفارة محظورات الترفه:
اتفق الفقهاء على أن مَن فعل من المحظورات شيئاً لعذر مرض، أو دفع أذى؛ فإن عليه الفدية، يتخير فيها:
إما أن يذبح هدياً، أو يتصدق بإطعام ستة مساكين، أو يصوم ثلاثة أيام.
لقوله تعالى: {وَلاَ تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ} [البقرة: 196].
ولما ورد عن كعب بن عجرة رضي الله عنه أن رسول الله صلى الله عليه وسلم قال له حين رأى هَوَامَّ رأسه: "أَيُؤْذِيكَ هَوَامُّ رَأْسِكَ"؟ قال: قلت: نعم. قال: "فَاحْلِقْ، وَصُمْ ثَلاَثَةَ أَيَّامٍ، أَوْ أَطْعِمْ سِتَّةَ مَسَاكِينَ، أَوِ انْسُكْ نَسِيكَةً"( [1] ) .
وأما العامد الذي لا عذر له فقد اختلفوا فيه:
فذهب جمهور الفقهاء( [2] ) إلى أنه يتخير، كالمعذور، وعليه إثم ما فعله. واستدلوا بالآية.
وذهب الحنفية( [3] ) إلى أن العامد لا يتخير، بل يجب عليه الدم عيناً، أو الصدقة عيناً، حسب جنايته. واستدلوا على ذلك بالأدلة السابقة.
وجه الاستدلال: أن التخيير شرع فيها عند العذر من مرض أو أذى، وغير المعذور جنايته أغلظ، فتتغلظ عقوبته، وذلك بنفي التخيير في حقه.
