أولاً: قتل الصيد:

وجوب الجزاء في قتل الصيد عمداً متفق عليه؛ عملاً بنص الآية: {يَاأَيُّهَا الَّذِينَ آمَنُوا لَا تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ وَمَنْ قَتَلَهُ مِنْكُمْ مُتَعَمِّدًا فَجَزَاءٌ مِثْلُ مَا قَتَلَ مِنَ النَّعَمِ يَحْكُمُ بِهِ ذَوَا عَدْلٍ مِنْكُمْ هَدْيًا بَالِغَ الْكَعْبَةِ أَوْ كَفَّارَةٌ طَعَامُ مَسَاكِينَ أَوْ عَدْلُ ذَلِكَ صِيَامًا لِيَذُوقَ وَبَالَ أَمْرِهِ عَفَا اللَّهُ عَمَّا سَلَفَ وَمَنْ عَادَ فَيَنْتَقِمُ اللَّهُ مِنْهُ وَاللَّهُ عَزِيزٌ ذُو انْتِقَامٍ} [المائدة: 95]..

إن غير العمد في هذا الباب كالعمد، يجب فيه الجزاء باتفاق المذاهب الأربعة؛ لأن العقوبة هنا شرعت ضماناً لِلْمُتْلَفِ، وذلك يستوي فيه العمد، والخطأ، والجهل، والسهو، والنسيان⁽[1]⁾.

إن هذا الجزاء هو كما نصت الآية: {مِثْل مَا قَتَل مِنَ النَّعَمِ}.

ويخير فيه بين الخصال الثلاث.

لكن اختلفوا بعد هذا في تفسير هذين الأمرين:

ذهب الحنفية: إلى أنه تقدر قيمة الصيد بتقويم رجلين عدلين، سواء أكان للصيد المقتول نظير من الأنعام أم لم يكن له نظير.

وتعتبر القيمة في موضع قتله، ثم يخير الجاني بين ثلاثة أمور:

الأول - أن يشتري هَدْيَاً، ويذبحه في الحرم إن بلغت القيمة هَدْيَاً.

ويزاد على الهدي في مأكول اللحم إلى اثنين أو أكثر إن زادت قيمته، لكنه لا يتجاوز هدياً واحداً في غير مأكول اللحم.

الثاني - أن يشتري بالقيمة طعاماً ويتصدق به على المساكين، لكل مسكين نصف صاع من بر، أو صاع من شعير أو تمر كما في صدقة الفطر.

ولا يختص التصدق بمساكين الحرم.

الثالث - أن يصوم عن طعام كل مسكين يوماً، وعن أقل من نصف صاع - إذا فَضَل - يوماً ⁽[2]⁾.

وذهب جمهور الفقهاء إلى التفصيل فقالوا:

الصيد ضربان:

مثلي: وهو ما له مِثْلٌ من النعم، أي مشابه في الخلقة من النعم، وهي الإبل والبقر والغنم.

وغير مثلي، وهو ما لا يشبه شيئاً من النعم.

أما المثلي: فجزاؤه على التخيير والتعديل، أي إن القاتل يُخَيَّر بين ثلاثة أشياء على الوجه التالي:

الأول - أن يذبح المِثْلَ المشابِهَ من النَّعم في الحرم، ويتصدقَ به على مساكين الحرم.

الثاني - أن يُقَوِّمَ الْمِثْلَ دراهمَ، ثم يشتريَ بها طعاماً، ويتصدقَ به على مساكين الحرم.

ولا يجوز تفرقة الدراهم عليهم.

وقال مالك بل يُقَوِّمُ الصيد نفسه، ويشتري به طعاماً؛ يتصدق به على مساكين موضع الصيد، فإن لم يكن فيه مساكين فعلى مساكين أقرب المواضع فيه.

الثالث - إن شاء صام عن كل مُدٍّ يوماً.

وفي أقل من مد يجب صيام يوم.

ويجوز الصيام في الحرم وفي جميع البلاد.

وأما غير المثلي: فيجب فيه قيمته ويتخير فيها بين أمرين:

الأول - أن يشتري بها طعاما يتصدقُ به على مساكين الحرم.

وعند مالك: على المساكين في موضع الصيد.

الثاني - أن يصوم عن كل مُدٍّ يوماً.
