مطلب: في أحكام كفارات محظورات الإحرام:
كفارات محظورات الإحرام أربعة أمور، هي: الهدي، والصدقة، والصيام، والقضاء، والكلام هنا على أحكامها الخاصة بهذا الموضوع:
الهدي
الهدي اصطلاحاً: ما يهدى إلى الحرم من الإبل والبقر والغنم( [1] ) .
الحكم التكليفي:
يختلف الحكم التكليفي للهدي بحسب نوعه، ونبين حكم كل نوع فيما يلي:
النوع الأول: هدي التطوع:
أ - لمريد النسك:
هدي التطوع هو الذي يتقرب به إلى الله دون سبب ملزم؛ اقتداء بالنبي صلى الله عليه وسلم، فقد أهدى النبي صلى الله عليه وسلم في حجة الوداع مائة بدنة( [2] ) .
قال النووي: اتفقوا على أنه يستحب لمن قصد مكة بحج أو عمرة أن يُهْدِي هدياً من الأنعام وينحره هناك، ويفرقه على المساكين الموجودين في الحرم( [3] ) .
ب - لمن لم يرد الحج:
ذهب الفقهاء إلى أنه يسن لمن لم يرد الذهاب إلى الحج أن يرسل هدياً، وأن يُشْعِرَهُ وَيُقَلِّدَهُ، ولا يَحْرُم عليه بإرساله شيءٌ مما يحرم على المحرم( [4] ) .
واستدلوا بما ورد عن عائشة رضي الله عنها قالت: "فَتَلْتُ قَلاَئِدَ بُدْنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِيَدِي، ثُمَّ أَشْعَرَهَا وَقَلَّدَهَا، ثُمَّ بَعَثَ بِهَا إِلَى الْبَيْتِ، وَأَقَامَ بِالْمَدِينَةِ، فَمَا حَرُمَ عَلَيْهِ شَيْءٌ كَانَ لَهُ حِلًّا"( [5] ) .
