874 الأكل من الهدي البالغ محله 24 3 1443 30 10 2021 الباب السابع: الحج مطلب: تعريف الحج. مطلب: الحكم التكليفي للحج. مطلب: وجوب الحج على الفور أو التراخي. مطلب: شروط فرضية الحج. مطلب: شروط صحة الحج. مطلب: الإحرام. مطلب: أركان الحج. مطلب: واجبات الحج. مطلب: سنن الحج. مطلب: مستحبات الحج. مطلب: كيفيات الحج. مطلب: طواف الوداع. مطلب: ممنوعات الحج. مطلب: في أحكام كفارات محظورات الإحرام: الهدي التصرف في الهدي بعد نحره: بيع شيء من الهدي: الأكل من الهدايا: الهدي إما أن يكون بالغا الكعبة وإما ألا يكون كذلك. ونوضح حكم كل فيما يلي: أولاً: الهدي البالغ محله: ويختلف حكم الأكل منه باختلاف نوع الهدي: أ - دماء الكفارات وهدي الإحصار: اختلف الفقهاء في الأكل من هدايا الكفارات والإحصار: فذهب جمهور الفقهاء إلى أنه لا يجوز للمُهْدِي أن يأكل من هدايا الكفارات والإحصار، ويجب عليه التصدق بلحمها بعد الذبح، لأنه ـ تعليل لوجوب التصدق ـ إذا لم يجز أكله للمُهْدِي ولا يتصدق به؛ فإنه يؤدي إلى إضاعة المال وهو منهي عنه شرعاً([1]). ويرى المالكية أنه يجوز للمُهْدِي الأكل من هذه الهدايا([2]). ب - الهدي المنذور: اختلف الفقهاء في حكم الأكل من الهدي المنذور. فذهب جمهور الفقهاء إلى أنه لا يجوز للمُهْدِي الأكل من الهدي المنذور، وهو رأي المالكية إذا كان الهدي المنذور معيناً، أما غير المعين فيجوز للمُهْدِي الأكل منه([3]). ج - هدي التمتع والقران: اختلف الفقهاء في حكم أكل المُهْدِي من هدي التمتع والقران. فذهب جمهور الفقهاء إلى أنه يجوز للمُهْدِي أن يأكل من هدي التمتع والقران، بل صرح الحنفية بأنه يستحب للمُهْدِي أن يأكل منه ويجوز أن يطعم الغني([4]). وذهب الشافعية إلى أنه لا يجوز للمُهْدِي أكل شيء منه([5]). د - هدي التطوع([6]): ذهب جمهور الفقهاء إلى أنه يستحب للمُهْدِي الأكل من هدي التطوع. واستدلوا بقوله تعالى: {فَكُلُوا مِنْهَا} [الحج: 28]، وأقل أحوال الأمر الاستحباب. وبأن النبي صلى الله عليه وسلم أكل من بُدُنِه، فقد ورد أنه عليه الصلاة والسلام نحر ثلاثاً وستين بدنة بيده، ونحر علي رضي الله عنه ما بقي من المئة، ثم أمر من كل بدنة ببضعة فجعلت في قدر، فطُبِخت، فأكلا من لحمها، وشربا من مرقها([7]). وبهذا يقول المالكية إذا لم يكن هدي التطوع معيناً، أما إذا نوى المُهْدِي الهدي للمساكين أو سماه لهم - عَيَّن أم لا - فإنه يحرم الأكل منه.     ([1]) البحر الرائق شرح كنز الدقائق 3/76، وكشاف القناع عن متن الإقناع، البهوتي 3/20، ومغني المحتاج إلى معرفة معاني ألفاظ المنهاج، الشربيني الخطيب 1/530 - 531.
