الصيام في كفارات محظورات الإحرام:
أولاً: مِن وجب عليه التكفير عن المحظور بالصيام فإنه يراعي فيه أحكام الصيام، ولا سيما تبييت النية بالنسبة للواجب غير المعين.
ثانياً: الصيام المقرر جزاء عن المحظور لا يتقيد بزمان ولا مكان ولا تتابعٍ اتفاقاً.
إلا الصيام لِمَن عجز عن هدي القران والتمتع، فإنه يصوم ثلاثة أيام في الحج، وسبعة إذا رجع إلى أهله.
فلا يصح صيام الأيام الثلاثة قبل أشهر الحج، ولا قبل إحرام الحج والعمرة في حق القارن، ولا قبل إحرام العمرة في حق المتمتع اتفاقاً.
أما تقديمها للمتمتع على إحرام الحج فمنعه المالكية والشافعية( [1] ) ؛ لقوله تعالى: {فَصِيَامُ ثَلاَثَةِ أَيَّامٍ فِي الْحَجِّ} [البقرة: 196]، وأجازه الحنفية والحنابلة( [2] ) ؛ لأنه وقت كامل جاز فيه نحر الهدي، فجاز فيه الصيام.
وأما الأيام السبعة الباقية على مَن عجز عن هدي القران والتمتع، فلا يصح صيامها إلا بعد أيام التشريق، ثم يجوز صيامها بعد الفراغ من أفعال الحج، ولو في مكة، إذا مكث بها، عند الحنفية والمالكية والحنابلة( [3] ) .
والأفضلُ المستحبُ أن يصومها إذا رجع إلى أهله، وهو قول عند الشافعية، لكن الأظهر عند الشافعية أنه يصوم الأيام السبعة إذا رجع إلى أهله، ولا يجوز أن يصومها في الطريق، إلا إذا أراد الإقامة بمكة، صامها بها( [4] ) .
والدليل للجميع قوله تعالى: {وَسَبْعَةٍ إِذَا رَجَعْتُمْ} [البقرة: 196].
