أ - يستحب للمضحي بعد الذبح أمور:
ب - يكره للمضحي بعد الذبح أمور:
يكره للمضحي بعد الذبح عند الحنفية أمور، منها:
بيع شيء من لحمها، أو شحمها، أو صوفها، أو شعرها، أو وبرها، أو غير ذلك إذا كان البيع بدراهم أو دنانير أو مأكولات، أو نحو ذلك مما لا يُنْتَفَع به إلا باستهلاك عينه، فهذا البيع لا يَحِلُّ، وهو مكروه تحريماً.
بخلاف ما لو باع شيئاً منها بما يمكن الانتفاع به مع بقاء عينه من متاع البيت أو غيره، كالإناء النحاس، وَالْمُنْخُل، والعصا، والثوب، والخف، فإنه يحل.
وإنما لم يحل البيع بما يُسْتَهْلَكُ؛ لقوله: "مَنْ بَاعَ جِلْدَ أُضْحِيَّتِهِ فَلاَ أُضْحِيَّةَ لَهُ"( [1] ) ؛ فإن باع نفذ البيع عند أبي حنيفة ومحمد. ووجب عليه التصدق بثمنه، ولا ينفذ البيع عند أبي يوسف فعليه أن يسترده من المشتري، فإن لم يستطع وجب التصدق بثمنه( [2] ) .
وصرح المالكية بأنه لا يجوز بيع شيء منها بعد الذبح ولا إبداله.
وهذا بالنسبة لصاحبها.
وأما الذي أهدي إليه شيء منها، أو تصدق عليه به، فيجوز له البيع والإبدال( [3] ) .
وعند الشافعية والحنابلة: لا يجوز للمضحي بيع شيء منها، وكذلك لا يجوز للغني المهدى إليه؛ بخلاف الفقير المتصدَّق عليه؛ فإنه يجوز له البيع.
ويجوز للمضحي التصدقُ بالجلد وإعارتهُ والانتفاعُ به، لا بيعُه، ولا إجارتُه( [4] ) .
