الكفاءة
المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة.
أ – الكفاءة في الدّين:
ذهب جمهور الفقهاء إلى أنّ من خصال الكفاءة الدّين، أي: المماثلة والمقاربة بين الزوجين في التديّن بشرائع الإسلام، لا في مجرد أصل الإسلام، ولهم فيما وراء ذلك تفصيل:
فقال أبو حنيفة وأبو يوسف: لو أنّ امرأةً من بنات الصالحين زَوَّجت نفسها من فاسق، كان للأولياء حقّ الاعتراض؛ لأنّ التفاخر بالدّين أحقّ من التفاخر بالنّسب والمال، والتعيير بالفسق أشدّ وجوه التعيير. وقال محمد: لا تعتبر الكفاءة في الدّين؛ لأنّ هذا من أمور الآخرة، والكفاءة من أحكام الدّنيا، فلا يقدح فيها الفسق إلا إذا كان شيئاً فاحشاً؛ بأن كان الفاسق ممَن يسخر منه، ويضحك عليه. وعن أبي يوسف: أنّ الفاسق إن كان معلناً لا يكون كفئاً، وإن كان مستتراً يكون كفئاً([1] .
وقال المالكية: المراد بالدّين الإسلامُ مع السلامة من الفسق، ولا تشترط المساواة في الصلاح، فإنْ فُقِدَ الدّينُ، وكان الزوج فاسقاً فليس بكفء([2] .
وقال الشافعية: من خصال الكفاءة الدّين والصلاح والكفّ عما لا يحلّ، والفاسق ليس بكفء للعفيفة، وغير الفاسق - عدلاً كان أو مستوراً - كفء لها، ولا تعتبر الشّهرة بالصلاح، فغير المشهور بالصلاح كفء للمشهورة به، والفاسق كفء للفاسقة مطلقاً إلا إن زاد فسقه([3] .
وقال الحنابلة: الدّين مما يعتبر في الكفاءة، فلا تُزَوَّج عفيفةٌ عن الزّنا بفاجرٍ، أي: بفاسق؛ بقول أو فعل أو اعتقاد، ولا تُزَوَّج امرأةٌ عَدْلٌ بفاسق؛ كشارب خمر؛ لأنّه ليس بكفء، سَكِرَ منها أو لم يسكر، وقالوا: إذا زَوَّجَ كريمته من فاسق فقد قَطَعَ رَحِمَهُ([4] .
