981 الكفاءة في النّسب في الزواج 12 7 1443 14 2 2021   الكفاءة المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة. ب – الكفاءة في النّسب: من الخصال المعتبرة في الكفاءة عند الحنفية، والشافعية، والحنابلة([1]): النّسب، وعبر عنه الحنابلة بالمنصب، واستدلّوا على ذلك بقول عمر رضي الله تعالى عنه: لأمنعنّ فروج ذوات الأحساب إلا من الأكفاء، وفي رواية قلت: وما الأكفاء؟ قال: في الأحساب([2]). وذهب مالك وسفيان الثوريّ إلى عدم اعتبار النّسب في الكفاءة، فأهل الإسلام كلّهم بعضهم لبعض أكفاء، لقول الله تعالى: {إِنَّا خَلَقْنَاكُم مِّن ذَكَرٍ وَأُنثَى وَجَعَلْنَاكُمْ شُعُوبًا وَقَبَائِلَ لِتَعَارَفُوا إِنَّ أَكْرَمَكُمْ عِندَ اللَّهِ أَتْقَاكُمْ}([3])، وكان سفيان الثوريّ يقول: لا تعتبر الكفاءة في النّسب؛ لأنّ الناس سواسية([4])، قال صلى الله عليه وسلم: "لا فضل لعربيّ على عجميّ، ولا لعجميّ على عربيّ، ولا لأحمر على أسود، ولا أسود على أحمر إلا بالتقوى"([5])، وقد تأيد ذلك بقوله تعالى: {إِنَّ أَكْرَمَكُمْ عِندَ اللَّهِ أَتْقَاكُمْ}([6])، ولجمهور الفقهاء القائلين باعتبار النّسب في الكفاءة بعد اتّفاقهم على ما سبق تفصيل يمكن مراجعته في مطولات كتب الفقه ([7]).     ([1]) بدائع الصنائع 2/319، ونهاية المحتاج 6/252، ومطالب أولي النهى 5/85، والمغني 6/483.
