الكفاءة
المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة.
ما يترتب على تخلّف الكفاءة:
إذا تخلفت الكفاءة عند من يشترطونها لصحة النّكاح فإنّه يكون باطلاً أو فاسداً، أما من لا يعتبرونها لصحة النّكاح، ويرونها حقّاً للمرأة والأولياء فإنّ تخلّف الكفاءة لا يبطل النّكاح عندهم في الجملة، بل يجعله عرضةً للفسخ.
وللفقهاء وراء ذلك تفصيل:
قال الحنفية - على ظاهر الرّواية - إذا تزوجت المرأة غير كفء فللوليّ أن يفرّق بينهما؛ دفعاً للعار ما لم يجئ منه دلالة الرّضا.
والتفريق إلى القاضي؛ لأنّه مجتهد فيه، وكلّ من الخصمين يتشبث بدليل، فلا ينقطع النّزاع إلا بفصل القاضي، وما لم يفرّق فأحكام النّكاح ثابتة، يتوارثان به إذا مات أحدهما قبل القضاء، ولا يكون الفسخ طلاقاً؛ لأنّ الطلاق تصرّف في النّكاح، وهذا فسخ لأصل النّكاح؛ ولأنّ الفسخ إنّما يكون طلاقاً إذا فعله القاضي نيابةً عن الزوج، وهذا ليس كذلك، ولهذا لا يجب لها شيء من المهر إن كان قبل الدّخول، وإنْ دَخَل بها فلها المسمى، وعليها العدة، ولها نفقة العدة للدّخول في عقد صحيح، والخلوة الصحيحة عندهم في هذا كالدّخول.
وقالوا: إن قبض الوليّ المهر، أو جَهَّزَ به، أو طالب بالنفقة فقد رضي، لأنّ ذلك تقرير للنّكاح، وأنّه يكون رضاً، كما إذا زوجها فمَكَّنت الزوج من نفسها.
وإن سكت لا يكون قد رضي وإن طالت المدة، ما لم تلد، فليس له حينئذ التفريق؛ لأنّ السّكوت عن الحقّ المتأكّد لا يبطله، لاحتمال تأخّره إلى وقت يختار فيه الخصومة.
وعن شيخ الإسلام (خواهر زاده) أنّ له التفريق بعد الولادة أيضاً.
وإن رضي أحد الأولياء فليس لغيره ممن هو في درجته أو أسفل منه الاعتراض، لأنّ حق الأولياء لا يتجزأ، وهو دفع العار، فجُعِلَ كلّ واحد منهم كالمنفرد؛ لأنّه صح الإسقاط في حقّه، فيسقط في حقّ غيره ضرورة عدم التجزّؤ؛ كالعفو عن القصاص.
بخلاف ما إذا رضيت؛ لأنّ حقها غير حقّهم، إذ إنّ حقها صيانة نفسها عن ذلّ الاستفراش، وحقهم دفع العار، فسقوط أحدهما لا يقتضي سقوط الآخر.
وقال أبو يوسف: للباقين حقّ الاعتراض؛ لأنّه حقّ ثبت لجماعتهم، فإذا رضي أحدهم فقد أسقط حقه، وبقي حقّ الآخرين.
وإن كان الوليّ المعترض أقرب من الوليّ الذي رضي فله حقّ الاعتراض.
وروى الحسن عن أبي حنيفة - وروايته هي المختارة للفتوى عند الحنفية - أنّ المرأة إذا تزوجت بغير كفء لم يجز، ولا يصحّ العقد أصلاً، قال السرخسيّ: وهو أحوط، فليس كلّ وليّ يحسن المرافعة إلى القاضي، ولا كلّ قاض يعدل، فكان الأحوط سدَّ هذا الباب، قال في الخانية: هذا أصحّ وأحوط.
وقد نقل الكمال بن الهمام عن أبي الليث: أنّ للمرأة التي زوجت نفسها من غير كفء أن تمتنع عن تمكينه من وطئها؛ لأنّ من حجة المرأة أن تقول: إنّما تزوجتك على رجاء أن يجيز الوليّ، وعسى أن لا يرضى، فيفرّق( [1] ) .
