الكفاءة
المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة.
ما يترتب على تخلّف الكفاءة:
إذا تخلفت الكفاءة عند من يشترطونها لصحة النّكاح فإنّه يكون باطلاً أو فاسداً، أما من لا يعتبرونها لصحة النّكاح، ويرونها حقّاً للمرأة والأولياء فإنّ تخلّف الكفاءة لا يبطل النّكاح عندهم في الجملة، بل يجعله عرضةً للفسخ.
وللفقهاء وراء ذلك تفصيل:
وقال الشافعية: لو زوج الوليّ المنفرد المرأة غير كفء برضاها، أو زَوَّجَها بعض الأولياء المستوين غير كفء؛ برضاها ورضا الباقين ممن في درجته، صح التزويج؛ لأنّ الكفاءة حقّها وحقّ الأولياء، فإن رضوا بإسقاطها فلا اعتراض عليهم.
ولو زَوَّجَها الوليّ الأقرب غير كفء برضاها فليس للأبعد الاعتراض؛ إذ لا حق له الآن في التزويج.
ولو زَوَّجَها أحد الأولياء المستوين في الدرجة بغير الكفء برضاها دون رضاء باقي المستوين لم يصح التزويج به؛ لأنّ لهم حقّاً في الكفاءة، فاعتبر رضاهم.
ويستثنى ما لو زَوَّجَها بمن به جَبٌّ (مقطوع الذَّكَر) أَوْ عُنَّةٌ (ضعف أو عدم انتصاب الذَّكَر) برضاها، فإنّه يصحّ، وفي قول: يصحّ ولهم الفسخ؛ لأنّ النقصان يقتضي الخيار لا البطلان.
ويجري القولان في تزويج الأب أو الجدّ بكراً صغيرةً، أو بالغةً بغير رضاها من غير كفء، وفي الأظهر: التزويج باطل؛ لأنّه على خلاف الغبطة (المصلحة)، وفي الآخر: يصحّ، وللبالغة الخيار في الحال، وللصغيرة إذا بلغت، ويجري الخلاف في تزويج غير المجبر إذا أذنت في التزويج مطلقاً.
ولو طلبت مَن لا ولي خاصّاً لها أن يزوّجها السّلطان أو نائبه (القاضي الشرعي) بغير كفء ففعل: لم يصح تزويجه في الأصحّ؛ لأنّه نائب المسلمين ولهم حظّ في الكفاءة، والثاني: يصحّ كالوليّ الخاصّ، وصححه الْبُلْقِينِيُّ.
ولو كان للمرأة وليّ خاصّ، ولكن زَوَّجَها السّلطان (القاضي الشرعي) لغيبته (الولي) أو عضله أو إحرامه، فلا تُزَوَّج إلا مِن كفءٍ قطعاً؛ لأنّه نائب عنه في التصرّف، فلا يصحّ التزويج من غير كفء مع عدم إذنه.
ولو كان الوليّ حاضراً وفيه مانع من فسق ونحوه وليس بعده إلا السّلطان (القاضي الشرعي)، فزَوَّج السّلطان (القاضي الشرعي) مِن غير كفء برضاها فظاهر إطلاقهم طرد الوجهين([1] .
