الكفاءة
المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة.
تزويج من لا يوجد لها كفء:
نص بعض الشافعية على أنّه إذا كانت المرأة بحيث لا يوجد لها كفء أصلاً جاز للوليّ تزويجها - للضرورة - بغير الكفء([1] .
قال الحنابلة: إن تزوجت المرأة غير كفء، وكانت الكفاءة معدومةً حال العقد، فرضيت المرأة والأولياء كلّهم صح النّكاح على القول بأنّ الكفاءة ليست شرطاً في صحة النّكاح.
وإن لم يرض بعضهم ففيه روايتان عن أحمد:
إحداهما: أنّه باطل؛ لأنّ الكفاءة حقّ لجميعهم، والعاقد متصرّف فيها بغير رضاهم، فلم يصح، كتصرّف الفضوليّ.
والثانية: أنّه صحيح، بدليل "أنّ المرأة التي رفعت إلى النبيّ صلى الله عليه وسلم أنّ أباها زوجها من غير كفئها"، خَيَّرَها النبيّ صلى الله عليه وسلم، ولم يبطل النّكاح من أصله([2] ، ولأنّ العقد وقع بالإذن، والنقص الموجود فيه لا يمنع صحته، وإنّما يثبت خيار الفسخ، والحقّ في الخيار لمن لم يرض بالنّكاح من المرأة والأولياء كلّهم؛ لأنّ العار في تزويج من ليس بكفء عليهم أجمعين، وهذا الحقّ في الفسخ على الفور، وعلى التراخي؛ لأنّه خيار لنقص في المعقود عليه، فلا يسقط الخيار إلا بإسقاط العصبة الأولياء بقول مثلَ: أسقطنا الكفاءة، أو رضينا به غير كفء، ونحوه، وأما سكوتهم فليس رضاً، وخيار الزوجة يَسْقُط بما يدلّ على رضاها من قول أو فعل، كأن مكنته من نفسها عالمةً أنّه غير كفء.
ويملك الحقَ في خيار الفسخ لفقد الكفاءة الأبعدُ من الأولياء مع رضا الأقرب منهم به، ومع رضا الزوجة؛ دفعاً لما يلحقه من العار، فلو زوج الأب بنته بغير كفء برضاها، فللإخوة الفسخ؛ لأنّ العار في تزويج من ليس بكفء عليهم أجمعين([3] .
