الحرمات المؤبدة
المادة 34 - يحرم على الرجل:
1- زوجة أصله أو فرعه وموطوءة أحدهما
2- أصل موطوءته وفرعها وأصل زوجته.
مُحَرَّمات النّكاح
المحرّمات من النّساء نوعان:
أ - محرّمات على التّأبيد.
ب - محرّمات على التّأقيت.
أوّلاً: المحرّمات تحريماً مؤبّداً:
أسباب تأبيد حرمة التّزوج بالنّساء ثلاثة، هي:
أ - القرابة.
ب - المصاهرة.
ج - الرّضاع.
أ - المحرّمات بسبب القرابة:
ب - المحرّمات بسبب المصاهرة
يحرم بالمصاهرة أربعة أنواعٍ:
2) أصل الزّوجة وهي أمها وأم أمّها، وأم أبيها وإن علت؛ لقوله تعالى: {وَأُمَّهَاتُ نِسَائِكُمْ وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلَا جُنَاحَ عَلَيْكُمْ} [النساء: 23].
وقد اتّفق الفقهاء على أنّ أصول الزّوجة تحرّم متى دخل الزّوج بزوجته.
ولكنّهم اختلفوا فيما إذا عقد الزّوج على زوجته ولم يدخل بها؛ بأن طلّقها، أو مات عنها قبل الدخول بها.
فذهب جمهور الفقهاء إلى أنّ العقد على الزّوجة كافٍ في تحريم أصولها، وهذا معنى قول الفقهاء: العقد على البنات يحرّم الأمّهات.
وقال الفقهاء: إنّ النّصّ الدّالّ على التّحريم، وهو قوله تعالى: {وَأُمَّهَاتُ نِسَائِكُمْ} [النساء: 23] مطلق غير مقيّدٍ بشرط الدخول، لم يرد فيه شرط ولا استثناء، وأنّ الدخول في قوله تعالى: {مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ} [النساء: 23] راجع إلى: {وَرَبَائِبُكُمُ} [النساء: 23] لا إلى المعطوف عليه، وهو: {وَأُمَّهَاتُ نِسَائِكُمْ} [النساء: 23] فيبقى النّص على حرمة أمّهات النّساء، سواء دخل بها أو لم يدخل، وما دام النّص جاء مطلقاً فيجب بقاؤه على إطلاقه ما لم يرد دليل يقيّده.
وذهب آخرون إلى أنّ أصول الزّوجة لا تحرّم بمجرّد العقد عليها، وإنّما تحرّم بالدخول بها، مستدلّين بأنّ اللّه حرّم أمّهات النّساء، ثمّ عطف الرّبائب عليهنّ، ثمّ أتى بشرط الدخول، ولذا ينصرف شرط الدخول إلى أمّهات النّساء، وإلى الرّبائب، فلا يثبت التّحريم إلا بالدخول.
