الحرمات المؤبدة

المادة 35

1- يحرم من الرضاع ما يحرم من النسب إلا ما قرر فقهاء الحنفية استثناءه.

2- يشترط في الرضاع للتحريم أن يكون في العامين الأولين وأن يبلغ خمس رضعات متفرقات يكتفي الرضيع في كل منها قل مقدارها أو كثر.

مُحَرَّمات النّكاح

المحرّمات من النّساء نوعان:

أ - محرّمات على التّأبيد.

ب - محرّمات على التّأقيت.

أوّلاً: المحرّمات تحريماً مؤبّداً:

أسباب تأبيد حرمة التّزوج بالنّساء ثلاثة، هي:

أ - القرابة.

ب - المصاهرة.

ج - الرّضاع.

أ - المحرّمات بسبب القرابة:

ب - المحرّمات بسبب المصاهرة

ج - المحرّمات بسبب الرّضاع

يحرم من الرّضاع:

أ - أصول الشّخص من الرّضاع.

ب - فروعه من الرّضاع.

ج - فروع أبويه من الرّضاع.

د - فروع جدّيه إذا انفصلن بدرجة واحدةٍ، أي عمّاتُه، وخالاتُه رضاعاً، وهؤلاء يحرّمن نسباً، فكذلك يحرّمن رضاعاً.

وأمّا بنات عمّاته وأعمامه رضاعاً، وبنات خالاته وأخواله رضاعاً، فلا يحرّمن عليه^{(^[1])}.
