مطلب: الحكم التكليفي للوضوء:

يختلف الحكم التكليفي للوضوء بحسب اختلاف ما يُتَوَضَّأ لأجله، وتفصيله فيما يلي:

أولاً: ما يكون الوضوء له فرضاً:

أ - الصلاة:

اتفق الفقهاء على أن الوضوء فرض على المُحْدِث (مَن انتقض وضوؤه) إذا أراد القيام لصلاة الفرض أو النفل؛ لأن الله لا يقبل صلاة من غير طُهُور^([1]).

ونص الحنفية على أن الوضوء فرض لصلاة الجنازة؛ لأنها صلاة وإن لم تكن كاملة، وهو ما ذهب إليه سائر الفقهاء؛ إذ يشترط لصحة صلاة الجنازة عندهم ما يشترط لبقية الصلوات؛ من الطهارة الحكمية (زَوَالُ الْحَدَثِ)، أو الطهارة الحقيقية (زَوَالُ النَّجَاسَةِ الْحَقِيقِيَّةِ)؛ بَدَنَاً، وثوباً، ومكاناً، وستر العورة، واستقبال القبلة، والنية^([2]).

وذهب جمهور الفقهاء إلى أن الوضوء فرض لسجدة التلاوة؛ باعتبار أنه يشترط لسجدة التلاوة ما يشترط للصلاة^([3]).

ب – الطواف:

ذهب جمهور الفقهاء إلى أن الوضوء فرض للطواف فرضُه ونفلُه^([4])؛ لقول النبي صلى الله عليه وسلم: "الطَّوَافُ حَوْل الْبَيْتِ مِثْلُ الصَّلاَةِ، إِلاَّ أَنَّكُمْ تَتَكَلَّمُونَ فِيهِ، فَمَنْ تَكَلَّمَ فِيهِ فَلاَ يَتَكَلَّمَنَّ إِلاَّ بِخَيْرٍ"^([5]).

وذهب الحنفية إلى أن الوضوء للطواف واجب، واستدلوا على ما ذهبوا إليه بالحديث الآنف الذكر الذي استدل به جمهور الفقهاء وقالوا: إنه لما أشبه الطوافُ الصلاةَ من وجه قلنا بوجوب الطهارة، وعدم توقف صحته عليها.

وزادوا: إذا طاف الطائف الفرضَ مُحْدِثَاً: وجب عليه دَمٌ (ذبح خروف)، وإن طاف وكان جنباً فبَدَنَةٌ (ذبح جمل).

وإذا طاف الواجب؛ كطواف الوداع، أو النفل مُحْدِثَاً فالواجب صدقة، وإذا طاف الواجب أو النفل جُنُبَاٌ فالواجب دم (ذبح خروف)^([6]).

ج - مس المصحف:

اختلف الفقهاء في فرضية الوضوء لمس المصحف فذهب جمهور الفقهاء إلى أن الوضوء فرض لمس المصحف^([7])؛ لقوله تعالى: {لاَ يَمَسُّهُ إِلاَّ الْمُطَهَّرُونَ} [الواقعة: 79].
