أنواع الوطن بالمفهوم الشرعي:
للوطن أنواع: وطن أصلي، ووطن إقامة، ووطن سكنى.
الوطن الأصلي، ما ينتقض به الوطن الأصليّ.
وطن الإقامة، ما ينتقض به وطن الإقامة.
وطن السكنى، ما ينتقض به وطن السكنى.
صيرورة المقيم مسافراً، وشرائطها.
تحديد أقل مسافة السفر بالأيام:
ذهب المالكية والشافعية والحنابلة([1] : إلى أن أقل مدة السفر مسيرةُ يومين معتدلين بلا ليلة، أو مسيرةُ ليلتين معتدلتين بلا يوم، أو مسيرةُ يوم وليلة. وذلك؛ لأنهم قدروا السفر بالأميال، واعتبروا ذلك ثمانية وأربعين ميلاً([2] ، وذلك أربعة بُرُد([3] ، وتقدَّر بسير يومين معتدلين.
واستدلوا بأن رسول الله صلى الله عليه وسلم قال: "يَا أَهْل مَكَّةَ: لاَ تَقْصُرُوا الصَّلاَةَ فِي أَدْنَى مِنْ أَرْبَعَةِ بُرُدٍ، مِنْ مَكَّةَ إِلَى عُسْفَانَ"([4] .
وبوضع علامة بين المدينتين على برنامج الخرائط المعاصر، تظهر المسافة بـ (85) كيلو متر.
ولأن ابن عمر وابن عباس رضي الله عنهم كَانَا يَقْصُرَانِ وَيُفْطِرَانِ فِي أَرْبَعَةِ بُرُدٍ فَمَا فَوْقَهَا، ولا يُعرَف لهما مخالف، وأورده البيهقي بسند صحيح، ومثلُ هذا لا يكون إلاّ عن توقيف، وعلّقه البخاريّ بصيغة الجزم.
وذهب الحنفيّة إلى أنّ أقلَّ مسافة السّفر مسيرةُ ثلاثة أيّام ولياليها، لما روي عن عليّ بن أبي طالب رضي الله عنه أنّه سُئِل عَنِ الْمَسْحِ عَلَى الْخُفَّيْنِ، فَقَال: جَعَل رَسُول اللَّهِ صلى الله عليه وسلم ثَلاَثَةَ أَيَّامٍ وَلَيَالِيَهُنَّ لِلْمُسَافِرِ، وَيَوْمًا وَلَيْلَةً لِلْمُقِيمِ([5] ،
فقد جعل النّبيّ صلى الله عليه وسلم لكلّ مسافر أن يمسح ثلاثة أيّام ولياليها، ولن يتصوّر أن يمسح المسافر ثلاثة أيّام ولياليها، ومدّة السّفر أقلّ من هذه المدّة.
وكذلك قال النّبيّ صلى الله عليه وسلم: "لاَ يَحِل لاِمْرَأَةٍ تُؤْمِنُ بِاَللَّهِ وَالْيَوْمِ الآْخِرِ أَنْ تُسَافِرَ مَسِيرَةَ ثَلاَثِ لَيَالٍ إِلاَّ وَمَعَهَا مَحْرَمٌ"([6] ، فلو لم تكن المدّة مقدّرةً بالثّلاث لم يكن لتخصيص الثّلاث معنى.
وقد استحبّ ذلك الإمام الشّافعيّ؛ للخروج من الخلاف([7] .
