الفصل الثالث: صلاة الوتر
تعريف الوتر.
الحكم التكليفي لصلاة الوتر:
ذهب جمهور الفقهاء إلى أن الوتر سنة مؤكدة، وليس واجباً.
ودليل سنيته قول رسول الله صلى الله عليه وسلم: "إِنَّ اللَّهَ وِتْرٌ يُحِبُّ الْوِتْرَ، فَأَوْتِرُوا يَا أَهْل الْقُرْآنِ"([1] ، وأن رسول الله صلى الله عليه وسلم فعله وواظب عليه.
واستدلوا لعدم وجوبه بما ثبت: أن رسول الله صلى الله عليه وسلم سَأَلَهُ أَعْرَابِيٌّ: عَمَّا فَرَضَ اللَّهُ عَلَيْهِ فِي الْيَوْمِ وَاللَّيْلَةِ؟ فَقَال: "خَمْسُ صَلَوَاتٍ"، فَقَال: هَل عَلَيَّ غَيْرُهَا؟ قَال: "لاَ، إِلاَّ أَنْ تَطَوَّعَ"([2] .
وذهب أبو حنيفة - خلافاً لصاحبيه - وأَبُو بَكْرٍ الْمَرْوَزِيُّ من الحنابلة: إلى أن الوتر واجب، وليس بفرض، وإنما لم يجعلاه فرضاً؛ لأنه لا يَكْفُر جاحده، ولا يُؤَذَّن لصلاة الوتر كأذان الفرائض.
واستُدِل على وجوبه: بقول رسول الله صلى الله عليه وسلم: "الْوِتْرُ حَقٌّ، فَمَنْ لَمْ يُوتِرْ فَلَيْسَ مِنَّا" كَرَّرَ ثَلاَثًا([3] .
وبقوله صلى الله عليه وسلم: "إِنَّ اللَّهَ تَعَالَى أَمَدَّكُمْ بِصَلاَةٍ هِيَ خَيْرٌ لَكُمْ مِنْ حُمْرِ النَّعَمِ، وَهِيَ صَلاَةُ الْوِتْرِ، فَصَلُّوهَا مَا بَيْنَ صَلاَةِ الْعِشَاءِ إِلَى صَلاَةِ الْفَجْرِ"([4] ، وهو أمر، والأمر يقتضي الوجوب، ولأنه صلاة مؤقتة (لها وقت)، وتقضى (إذا فاتت).
