الفصل الثالث: صلاة الوتر

تعريف الوتر.

الحكم التكليفي لصلاة الوتر.

وقت صلاة الوتر.

عدد ركعات صلاة الوتر:

أقل صلاة الوتر عند الشافعية والحنابلة ركعة واحدة. قالوا: ويجوز ذلك بلا كراهة؛ لحديث: "صَلاَةُ اللَّيْل مَثْنَى مَثْنَى، فَإِذَا خِفْتَ الصُّبْحَ فَأَوْتِرْ بِوَاحِدَةٍ"^{(^[1])}، والاقتصار عليها خلاف الأولى، لكن في قول عند الشافعية: شرط الإيتار بركعة سَبْق نفل بعد العشاء من سنتها، أو غيرها لِيُوتِرَ النَّفَلَ.

وقال الحنفية: لا يجوز الإيتار بركعة، لأن رسول الله صلى الله عليه وسلم نَهَى عَنِ الْبُتَيْرَاءِ^{(^[2])}، قالوا: روي أن عمر رضي الله عنه رأى رجلاً يوتر بواحدة، فقال: ما هذه البتيراء؟ لَتَشْفَعَنَّهَا أَوْ لَأُؤَدِّبَنَّك^{(^[3])}.

وقال الشافعية والحنابلة: أكثر الوتر إحدى عشرة ركعة، وفي قول عند الشافعية أكثره ثلاث عشرة ركعة، ويجوز بما بين ذلك من الأوتار؛ لقول رسول الله صلى الله عليه وسلم: "مَنْ أَحَبَّ أَنْ يُوتِرَ بِخَمْسٍ فَلْيَفْعَل، وَمَنْ أَحَبَّ أَنْ يُوتِرَ بِثَلاَثٍ فَلْيَفْعَل، وَمَنْ أَحَبَّ أَنْ يُوتِرَ بِوَاحِدَةٍ فَلْيَفْعَل"^{(^[4])}، وقوله صلى الله عليه وسلم: "أَوْتِرُوا بِخَمْسٍ، أَوْ سَبْعٍ، أَوْ تِسْعٍ، أَوْ إِحْدَى عَشْرَةَ"^{(^[5])}، وقالت أم سلمة رضي الله عنها: كان رسول الله صلى الله عليه وسلم يُوتِرُ بِثَلاَثِ عَشْرَةَ رَكْعَةً^{(^[6])}.

وأدنى الكمال عند الشافعية والحنابلة ثلاث ركعات، فلو اقتصر على ركعة كان خلاف الأولى. ونص الحنابلة: على أنه لا يكره الإيتار بركعة واحدة، ولو بلا عذر، وأكمل من الثلاث خمس، ثم سبع، ثم تسع ثم إحدى عشرة، وهي أكمله^{(^[7])}.

أما الحنفية: فلم يذكروا في عدده إلا ثلاث ركعات، بتشهدين وسلام، كما يصلى المغرب. واحتجوا بقول عائشة رضي الله عنها كان رسول الله صلى الله عليه وسلم يُوتِرُ بِثَلاَثٍ لاَ يُسَلِّمُ إِلاَّ فِي آخِرِهِنَّ^{(^[8])}. قال ابن الهمام: وهو مروي عن فقهاء المدينة السبعة^{(^[9])}.

أما عند المالكية^{(^[10])}: فإن الوتر ركعة واحدة، لكن لا تكون إلا بعد شفع يسبقها. قالوا: والأصل في ذلك حديث: "صَلاَةُ اللَّيْل مَثْنَى مَثْنَى، فَإِذَا خَشِيَ أَحَدُكُمُ الصُّبْحَ صَلَّى رَكْعَةً وَاحِدَةً تُوتِرُ لَهُ مَا قَدْ صَلَّى"^{(^[11])}. وقالوا: لا يشترط في الشفع الذي قبل ركعة الوتر نية تخصه، بل يكتفي بأي ركعتين كانتا^{(^[12])}.
