الحكمة من مشروعية العيدين.

حكمها بعد خروج وقتها:
لفوات صلاة العيد عن وقتها ثلاث صور:
الصورة الأولى: أن تؤدى صلاة العيد جماعة في وقتها من اليوم الأول، ولكنها فاتت بعض الأفراد، وحكمها في هذه الصورة أنها فاتت إلى غير قضاء، فلا تقضى مهما كان العذر؛ لأنها صلاة خاصة لم تشرع إلا في وقت معين، وبقيود خاصة، فلا بد من تكاملها جميعاً، ومنها الوقت. وهذا عند الحنفية والمالكية([1] .
وأما الشافعية: فقد أطلقوا القول بمشروعية قضائها - على القول الصحيح في المذهب - في أي وقت شاء، وكيفما كان: منفرداً أو جماعة، وذلك بناء على أصلهم المعتمد، وهو أن نوافل الصلاة كلَّها يشرع قضاؤها([2] .
وأما الحنابلة: فقالوا: لا تقضى صلاة العيد، فإنْ أَحَبَّ قضاءها؛ فهو مخير إن شاء صلاها أربعاً، إما بسلام واحد، وإما بسلامين([3] .
الصورة الثانية: ألا تكون صلاة العيد قد أديت جماعة في وقتها من اليوم الأول، وذلك إما بسبب عذر: كأن غُمَّ عليهم الهلال، وشهد شهود عند القاضي برؤية الهلال بعد الزوال، وإما بدون عذر.
ففي حالة العذر: يجوز تأخيرها إلى اليوم الثاني سواء كان العيد عيد فطر أو أضحى؛ لأنه قد ثبت عن رسول الله صلى الله عليه وسلم: أن قوماً شهدوا برؤية الهلال في آخر يوم من أيام رمضان، فأمر عليه الصلاة والسلام بالخروج إلى المصلى من الغد([4] ، وهذا عند الحنفية والشافعية والحنابلة فيشرع قضاء صلاة العيد في اليوم الثاني عند تأخر الشهادة برؤية الهلال، أما المالكية: فقد أطلقوا القول بعدم قضائها في مثل هذه الحال([5] .
إلا أن الشافعية لا يعتبرون صلاتها في اليوم الثاني قضاء إذا تأخرت الشهادة في اليوم الذي قبله إلى ما بعد غروب الشمس، بل لا تقبل الشهادة حينئذ، ويعتبر اليوم الثاني أول أيام العيد، فتكون الصلاة قد أديت في وقتها([6] .
الصورة الثالثة: أن تؤخر صلاة العيد عن وقتها بدون العذر الذي ذكرنا في الصورة الثانية.
فينظر حينئذ: إن كان العيد عيد فطر سقطت أصلاً ولم تُقْضَ.
وإن كان عيد أضحى جاز تأخيرها إلى ثالث أيام النحر، أي يصح قضاؤها في اليوم الثاني، وإلا ففي اليوم الثالث، من ارتفاع الشمس في السماء إلى أول الزوال، سواء كان ذلك لعذر، أو لغير عذر، ولكن تلحقه الإساءة إن كان غير معذور بذلك([7] .
