الباب الرابع: الـــزكـــاة
الفصل الأول: مفهوم الزكاة
تعريف الزكاة.
الحكم التكليفي للزكاة.
مَن تجب في ماله الزكاة.
الزكاة في مال الصغير والمجنون.
الزكاة في الأموال المشتركة والأموال المختلفة والأموال المتفرقة.
شروط المال الذي تجب فيه الزكاة:
الشرط الأول: كون المال مملوكاً لمعين.
الشرط الثاني: أن تكون ملكية المال مطلقة:
الملك الناقص يكون في أنواع من المال معينة، منها:
زكاة الدَّيْن:
الدَّيْن مملوك للدائن، ولكنه لكونه ليس تحت يد صاحبه فقد تعددت فيه أقوال الفقهاء:
ذهب جمهور العلماء إلى أن الدَّيْن الحالَّ قسمان: دَيْن حالٌّ مرجو الأداء، دَيْن حالٌّ غير مرجو الأداء.
فالدَّيْن الحالُّ المرجو الأداء: هو ما كان على مُقِرٍّ به باذلٍ له، وفيه أقوال:
فمذهب الحنفية والحنابلة: أن زكاته تجب على صاحبه كل عام؛ لأنه مال مملوك له، إلا أنه لا يجب عليه إخراج الزكاة منه ما لم يقبضه، فإذا قبضه زكاه لكل ما مضى من السنين. ووجه هذا القول: أنه دَيْن ثابت في الذمة فلم يلزمه الإخراج قبل قبضه؛ ولأنه لا ينتفع به في الحال.
ومذهب الشافعي في الأظهر، أنه يجب إخراج زكاة الدَّيْن المرجو الأداء في نهاية كل حول، كالمال الذي هو بيده؛ لأنه قادر على أخذه والتصرف فيه([1] .
وجعل المالكية الدَّيْن أنواعاً: فبعض الديون يزكى كل عام، وهي دَيْن التاجر المدير عن ثمن بضاعة تجارية باعها، وبعضها يزكى لحول من أصله لسنة واحدة عند قبضه ولو أقام عند المدين سنين، وهو ما أقرضه لغيره من نقد، وكذا ثمن بضاعة باعها محتكر، وبعض الديون لا زكاة فيه، وهو ما لم يقبض من نحو هبة أو مهر أو عوض جناية([2] .
وأما الدَّيْن غير المرجو الأداء، فهو ما كان على معسر أو جاحد أو مماطل، وفيه أقوال([3] : فمذهب الحنفية، ورواية عن أحمد، وقول مقابل للأظهر للشافعي: أنه لا زكاة فيه لعدم تمام الملك؛ لأنه غير مقدور على الانتفاع به.
والقول الثاني وهو رواية عن أحمد، وقول للشافعي هو الأظهر: أنه يزكيه إذا قبضه لما مضى من السنين، لما روي عن علي رضي الله عنه في الدَّيْن المظنون: إن كان صادقاً؛ فليزكه إذا قبضه لما مضى.
وذهب مالك إلى أنه إن كان مما فيه الزكاة يزكيه إذا قبضه لعام واحد؛ وإن أقام عند المدين أعواماً.
