الفصل الأول: مفهوم الزكاة
تعريف الزكاة.
الحكم التكليفي للزكاة.
مَن تجب في ماله الزكاة.
الزكاة في مال الصغير والمجنون.
الزكاة في الأموال المشتركة والأموال المختلفة والأموال المتفرقة.
شروط المال الذي تجب فيه الزكاة:
الشرط الأول: كون المال مملوكاً لمعين.
الشرط الثاني: أن تكون ملكية المال مطلقة.
الشرط الثالث: النماء:
ووجه اشتراطه، أن من مقاصد شرعية الزكاة أن لا يصير المزكي فقيراً، بأن إنه يعطي من فضل (زيادة) ماله قليلاً من كثير([1] .
قالوا: والنماء متحقق في السوائم (الأنعام) بالدر والنسل، وفي الأموال المعدة للتجارة، والأرض الزراعية، وسائر الأموال التي تجب فيها الزكاة.
ولا يشترط تحقق النماء بالفعل بل تكفي القدرة على الاستنماء؛ بكون المال في يده، أو يد نائبه، واليوم هناك (النماء بالقوة)، بشراء العقارات التي ترتفع قيمتها على مر السنوات.
وبهذا الشرط لا تجب الزكاة في الثياب التي لا تراد لتجارة، وأثاث المنزل، وكتب العلم، والأنعام المعدة للحرث، أو الركوب، أو اللحم([2] .
أما الذهب والفضة (ويلحق بها كل الأثمان؛ النقود الورقية المحلية والأجنبية، والأسهم، وكل ما سيهل تحويله إلى سيولة نقدية) فلا يشترط فيهما النماء بالفعل؛ لأنهما للنماء خِلقة؛ فتجب الزكاة فيهما، نوى التجارة أو لم ينو أصلاً، أو نوى النفقة([3] .
