أجمع الفقهاء على أن الإبل والبقر والغنم هي من الأصناف التي تجب فيها الزكاة.
شروط وجوب الزكاة في الحيوان:
يشترط في الماشية لوجوب الزكاة فيها تمام الحول، وكونها نصاباً فأكثر، بالإضافة إلى شروط وجوب الزكاة في الأموال عامة.
ويشترط هنا شرطان آخران:
الشرط الأول: السوم: ومعناه أن يكون غذاؤها على الرعي من نبات البَر؛ فلو كانت معلوفة لم تجب فيها الزكاة عند جمهور الفقهاء، واستدلوا لذلك بما في الحديث: "فِي كُل سَائِمَةِ إِبِلٍ فِي كُل أَرْبَعِينَ بِنْتُ لَبُونٍ"([2] . وحديث: "فِي كُل خَمْسٍ مِنَ الإِبِل السَّائِمَةِ شَاةٌ"([3] ؛ فدل بمفهومه على أن المعلوفة لا زكاة فيها.
ثم اختلف القائلون بهذا،
فذهب الحنفية والحنابلة إلى أن السائمة هي التي تكتفي بالرعي في أكثر الحول؛ فلو علفها صاحبها نصف الحول أو أكثر كانت معلوفة ولم تجب زكاتها؛ لأن القليل تابع للكثير، ولأن أصحاب السوائم لا يجدون بُدَّاً من أن يعلفوا سوائمهم في بعض الأوقات؛ كأيام البرد والثلج([4] .
وذهب الشافعية على الأصح إلى أن التي تجب فيها الزكاة هي التي ترعى كل الحول، وكذا إن علفت قدراً قليلاً تعيش بدونه بلا ضرر بَيِّن تجب فيها الزكاة، فإن علفت أكثر من ذلك فلا زكاة فيها([5] .
وذهب المالكية إلى أن الزكاة تجب في الأنعام غير السائمة كوجوبها في السائمة حتى لو كانت معلوفة كل الحول. قالوا: والتقييد في الحديث بالسائمة؛ لأن السوم هو الغالب على مواشي العرب، فهو قيد اتفاقي؛ لبيان الواقع، لا مفهوم له (ليس له مفهوم مخالفة)([6] .
الشرط الثاني: ألا تكون عاملة، فالإبل المعدَّة للحمل والركوب، والنواضح المعدَّة لنقل المياه وجرِّها، وبَقَرِ الحرث والسقي لا زكاة فيها؛ ولو كانت سائمة.
هذا مذهب جمهور الفقهاء([7] ، واستدلوا بحديث: "لَيْسَ فِي الْبَقَرِ الْعَوَامِل شَيْءٌ"([8] .
وذهب المالكية وهو قول آخر للشافعية: إلى أن العمل لا يمنع الزكاة في الماشية؛ لعموم قول النبي صلى الله عليه وسلم: "فِي كُل خَمْسِ ذَوْدٍ([9] شَاةٌ"([10] .
