الباب الرابع: الـــزكـــاة
الفصل الرابع: مصارف الزكاة:

والغارمون المستحقون للزكاة ثلاثة أضرب:
الضرب الأول: مَن كان عليه دَيْن لمصلحة نفسه. وهذا متفق عليه من حيث الجملة.
ومما يشترط لإعطائه من الزكاة ما يلي([2] :
1 - اشترط المالكية ألا يكون قد استدان ليأخذ من الزكاة، كأن يكون عنده ما يكفيه، وتوسع في الإنفاق بالدَّيْن لأجل أن يأخذ منها، بخلاف فقير استدان للضرورة ناوياً الأخذ منها.
2 - ألا يكون دَيْنه في معصية، وهذا عند المالكية والشافعية والحنابلة؛ كأن يكون بسبب خمر، أو قمار، أو زنا، لكن إن تاب يجوز الدفع إليه، وعد الشافعية الإسراف في النفقة من باب المعصية التي تمنع الإعطاء من الزكاة.
3 - أن يكون الدَّيْن حَالاًّ (غير مؤجل)، صرح بهذا الشرط الشافعية.
4 - ألا يكون قادراً على السداد من مال عنده، زكويٍ، أو غيرِ زكوي، زائد عن كفايته؛ فلو كان له دار يسكنها تساوي مئة وعليه مئة، وتكفيه دار بخمسين فلا يُعْطَى حتى تباع، ويُدْفَع الزائد في دَيْنه على ما صرح به المالكية، ولو وَجَدَ ما يقضي به بعض الدَّيْن أُعْطِيَ البقية فقط، وإن كان قادراً على وفاء الدَّيْن بعد زمنٍ بالاكتساب، فعند الشافعية قولان في جواز إعطائه منها.
الضرب الثاني: الغارم لإصلاح ذات البين([3] :
الأصل فيه حديث قبيصة المرفوعُ إلى رسول الله صلى الله عليه وسلم: "إِنَّ الْمَسْأَلَةَ لاَ تَحِل إِلاَّ لِثَلاَثَةٍ"، فذكر منهم: "وَرَجُلٍ تَحَمَّل حَمَالَةً فَحَلَّتْ لَهُ الْمَسْأَلَةُ، حَتَّى يُصِيبَهَا، ثُمَّ يُمْسِكُ"([4] .
فذهب الشافعية والحنابلة إلى أن هذا النوع من الغارمين يُعْطَى من الزكاة، سواء كان غنياً أو فقيراً؛ لأنه لو اشتُرِط الفقر في الغارمين؛ لقلت الرغبة في هذه المكرمة، وصورتها: أن يكون بين قبيلتين، أو حيين فتنة، يكون فيها قتل نفس، أو إتلاف مال، فيتحمله شخص لأجل الإصلاح بينهم، فيُعْطَى هذا الشخص من مال الزكاة؛ لتسديد حمالته (ما تحمَّلَه).
وقال الحنفية: لا يعطى المتحمل من الزكاة إلا إن كان لا يملك نصاباً فاضلاً عن دَيْنه، كغيره من المدينين.
الضرب الثالث: الغارم بسبب دَيْنِ ضمانٍ.
وهذا النوع ذكره الشافعية، والمعتبر في ذلك أن يكون كل من الضامن والمضمون عنه معسرين.
