الباب الرابع: الـــزكـــاة
الفصل الرابع: مصارف الزكاة:
بيان الأصناف الثمانية:
المبحث الأول: الصنفان الأول والثاني: الفقراء والمساكين.

وهذا الصنف ثلاثة أضرب.
الضرب الأول([1] : المجاهدون في سبيل الله تعالى، المتطوعون.
وهذا الضرب متفق عليه عند الفقهاء من حيث الجملة، فيجوز إعطاؤهم من الزكاة قدر ما يتجهزون به للجهاد؛ من مركب، وسلاح، ونفقة، وسائر ما يحتاج إليه المجاهد مدة الجهاد؛ وإن طالت.
وأما الجنود في الجيش المتفرغون، فلا يعطون من الزكاة؛ لأنهم يستحقون المرتب لهم.
الضرب الثاني([2] : مصالح الجهاد (العَتَاد).
وهذا الضرب ذكره المالكية والشافعية، حيث يجوز الصرف من الزكاة في مصالح الجهاد؛ نحو شراء الأسلحة، أو تصنيعها.
الضرب الثالث: الحجاج([3] :
ذهب أحمد في رواية، إلى أن الحج (في سبيل الله) فيُصْرَف فيه من الزكاة، لما رُوِي أن رجلاً جعل ناقته في سبيل الله، فأرادت امرأته أن تَحُجَّ، فقال لها رسول الله صلى الله عليه وسلم: "فَهَلاَّ خَرَجْتِ عَلَيْهِ؛ فَإِنَّ الْحَجَّ مِنْ سَبِيل اللَّهِ"([4] .
فعلى هذا القول يعطى من الزكاة لحج الفريضة بوجه خاص، وفي قول عند الحنابلة: يجوز في حج التطوع.
وينقل عن بعض فقهاء الحنفية أن مصرف في سبيل الله هو لمن انقطع أثناء الحج (منقطع الحجاج).
وعند الشافعية يعطى مريد الحج من الزكاة على أنه ابن سبيل.
وذهب جمهور العلماء إلى أنه لا يجوز الصرف في الحج من الزكاة؛ لأن سبيل الله (في آية مصارف الزكاة) مطلق، وهو عند الإطلاق ينصرف إلى الجهاد في سبيل الله، وليس إلى (الحج).
