ما يراعى في قسمة الزكاة بين الأصناف الثمانية:
أ - تعميم الزكاة على الأصناف:
ذهب جمهور العلماء (الحنفية والمالكية وهو المذهب عند الحنابلة) إلى أنه([1] : لا يجب تعميم الزكاة على الأصناف، سواء كان المال كثيراً أو قليلاً، بل يجوز أن تعطى لصنف واحد، أو أكثر، ويجوز أن تعطى لشخص واحد، إن لم تزد عن كفايته؛ واحتجوا بحديث: "تُؤْخَذُ مِنْ أَغْنِيَائِهِمْ وَتُرَدُّ عَلَى فُقَرَائِهِمْ"([2] ، قالوا: والفقراء صنف واحد من أصناف أهل الزكاة الثمانية، وبوقائع أعطى فيها النبي صلى الله عليه وسلم الزكاة لفرد واحد، أو أفراد.
وذهب الشافعية، ورواية عن أحمد، إلى أنه يجب تعميم الأصناف، وإعطاء كل صنف منهم الثُمُن (12.5 %) من الزكاة المتجمعة، واستدلوا بآية الصدقات، فإنه تعالى أضاف الزكاة إليهم فاللام للتمليك، وأشرك بينهم بواو التشريك، فدل على أنها مملوكة لهم، مشترَكة بينهم.
ب - وينبغي للإمام أو الساعي (مؤسسات العناية بالزكاة جمعاً وتوزيعاً) أن يعتني بضبط المستحقين، ومعرفة أعدادهم، وقدر حاجاتهم، واستحقاقهم، بحيث يقع الفراغ من جمع الزكوات بعد معرفة ذلك، أو معه ليتعجل وصول حقهم إليهم.
