التقديم

2/1 طرق تحديد وعاء الزكاة:
2/2 إخراج المؤسسة للزكاة مباشرة:
2/2/1 تلزم المؤسسة، أو الشركة، بإخراج الزكاة في الحالات الآتية:
أ- صدور قانون ملزم بإخراج الزكاة.
ب- النص في النظام الأساسي على الالتزام بإخراج الزكاة.
ج- صدور قرار من الجمعية العمومية بالالتزام بإخراج الزكاة.
2/2/2 في حالة قبول المؤسسة توكيل كل أو بعض أصحاب حقوق الملكية أو أصحاب حسابات الاستثمار يشترط توافر أو تقديم مبالغ خاصة بالموكلين لأداء الزكاة عنهم.
2/2/3 يجب التنسيق بين الشركة الأم والشركات التابعة بشأن إخراج الزكاة حتى لا يتكرر إخراجها.
2/2/4 في حالة تكوين صندوق للزكاة، أو إعداد حساب الزكاة يجب اعتماد ذلك من الهيئة الشرعية للمؤسسة أو الشركة، وبخاصة وجوه الصرف في حال قيام المؤسسة بذلك مباشرة، أو عن طريق توكيل المؤسسة جهة معتمدة معنية بشئون الزكاة، ورفع تقرير سنوي للهيئة بذلك.
2/2/5 عند عدم توافر إحدى الحالات المذكورة في الفقرة 2/2/1 تكون مسئولية إخراج الزكاة على المساهمين وأصحاب حسابات الاستثمار، ويجب على المؤسسة أو الشركة بيان مقدار الزكاة الواجبة في السهم، أو مبالغ الحسابات الاستثمارية.
