701 تبييت النية شرط صحة الصوم 28 9 1442 10 5 2021 الباب الخامس: كتاب الصيام   تعريف الصوم. الحكم التكليفي. فضل الصيام. أنواع الصيام. ثبوت الأهلة. ركن الصوم. شروط الصوم: أهم شرط لصحة الصوم: النية. وصفة النية أن تكون جازمة، معينة، مبيتة، مجددة، على ما يلي: أولاً: الجزم. ثانياً: التعيين. ثالثاً: التبييت: وهو شرط في صوم الفرض عند جمهور الفقهاء، والتبييت: إيقاع النية في الليل، ما بين غروب الشمس إلى طلوع الفجر([1]). وذلك لحديث ابن عمر، عن حفصة رضي الله عنهم عن النبي صلى الله عليه وسلم أنه قال: "مَنْ لَمْ يُجْمِعِ الصِّيَامَ قَبْل الْفَجْرِ، فَلاَ صِيَامَ لَهُ"([2]). ولم يشترط الحنفية التبييت للنية في رمضان([3])، ولما لم يشترطوا تبييت النية في ليل رمضان، أجازوا النية بعد الفجر؛ دفعاً للحرج، حتى الضحوة الكبرى، فينوي قبلها ليكون الأكثر من النهار منوياً، فيكون له حكم الكل. والضحوة الكبرى: نصف النهار الشرعي، وهو من وقت طلوع الفجر إلى غروب الشمس. وقالوا: الأفضل الصوم بنية معينة مبيتة؛ للخروج عن الخلاف([4]). ودليل الحنفية على ما ذهبوا إليه، من صحة النية حتى الضحوة الكبرى، وعدم شرطية التبييت: حديث ابن عباس رضي الله عنهما أن الناس أصبحوا يوم الشك، فقدم أعرابي، وشهد برؤية الهلال، فقال صلى الله عليه وسلم: "أَتَشْهَدُ أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ، وَأَنِّي رَسُول اللَّهِ"؟ فقال: نعم، فقال عليه الصلاة والسلام: "اللَّهُ أَكْبَرُ، يَكْفِي الْمُسْلِمِينَ أَحَدُهُمْ"، فصام، وأمر بالصيام، وأمر منادياً فنادى: "أَلاَ مَنْ أَكَل فَلاَ يَأْكُل بَقِيَّةَ يَوْمِهِ، وَمَنْ لَمْ يَأْكُل فَلْيَصُمْ"([5]). واستدلوا بما ورد في الحديث أن النبي صلى الله عليه وسلم أرسل غداة عاشوراء إلى قرى الأنصار: "مَنْ أَصْبَحَ مُفْطِرًا فَلْيُتِمَّ بَقِيَّةَ يَوْمِهِ، وَمَنْ أَصْبَحَ صَائِمًا فَلْيَصُمْ"([6]). وكان صوم عاشوراء واجباً، ثم نسخ بفرض رمضان([7]). واشترط الحنفية تبييت النية في صوم الكفارات، والنذور المطلقة، وقضاء رمضان. أما النفل فيجوز صومه عند جمهور الفقهاء بنية؛ قبل الزوال([8])؛ لحديث عائشة رضي الله عنها قالت: دخل عليَّ النبي صلى الله عليه وسلم ذات يوم، فقال: "هَل عِنْدَكُمْ شَيْءٌ"؟، فقلنا: لا، فقال: "فَإِنِّي إِذًا صَائِمٌ"([9]). ومذهب المالكية: أنه يشترط في صحة الصوم مطلقاً، فرضاً أو نفلاً، نية مبيتة([10])، وذلك لإطلاق الحديث: "مَنْ لَمْ يُجْمِعِ الصِّيَامَ قَبْل الْفَجْرِ، فَلاَ صِيَامَ لَهُ"([11]). ومذهب الحنابلة جواز النية في النفل، قبل الزوال وبعده، واستدلوا بحديث عائشة، وحديث صوم يوم عاشوراء([12]).         ([1]) حاشية الدسوقي على الشرح الكبير، الدردير 1/520 و 521، والقوانين الفقهية ص 80، وشرح المحلي على المنهاج وحاشية قليوبي 2/52، وحاشية البجيرمي على شرح الإقناع في حل ألفاظ أبي شجاع، الشربيني الخطيب 2/326.
