تجب الزكاة في الخارج من الأرض من كل مكيل مدخر من الحَبِّ، ومن الثمر، ودليل الوجوب قول الله تعالى: {يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ} [البقرة: 267]، وفي صحيح البخاري ج4 (2/ 126)، (1483) عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "فِيمَا سَقَتْ السَّمَاءُ وَالْعُيُونُ أَوْ كَانَ عَثَرِيًّا الْعُشْرُ، وَمَا سُقِيَ بِالنَّضْحِ نِصْفُ الْعُشْرِ". والعثري: هو الذي يشرب بعروقه من غير سقي، والمراد بالنضح هنا السواقي. ولا يشترط أن يحول عليه الحول. دليل وجوب الزكاة في كل ما تنبته الأرض من قليل وكثير عموم هذه الآية. وقول الله تعالى: {وَآتُواْ حَقَّهُ يَوْمَ حَصَادِهِ} [الأنعام: 141]. وعموم ما جاء في السنن الكبرى للبيهقي (4/ 130)، 7740- عَنْ أَبِى هُرَيْرَةَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ: «فِيمَا سَقَتِ السَّمَاءُ الْعُشْرُ، وَفِيمَا سُقِىَ بالنَّضْحِ نِصْفُ الْعُشْرِ». ولم يقبل التخصيص بما في صحيح مسلم (3/ 66)، 2310 - عَنْ أَبِى سَعِيدٍ الْخُدْرِىِّ عَنِ النَّبِىِّ صلى الله عليه وسلم قَالَ: «لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ». لأن القاعدة في علم الأصول أن العام قطعي الشمول للأفراد. تجب الزكاة في كل حب يُكال ويُدَّخر، بشرط أن يبلغ نصاباً؛ لعموم هذه الآية، ولقول رسول الله صلى الله عليه وسلم: «لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ» متفق عليه، (612 كيلو جرام)، ومقدار الزكاة: العشر فيما سقي بلا مؤونة؛ كالذي يُسْقى بمياه الأمطار أو الأنهار، ونصف العشر فيما سُقِي بمؤونة؛ كالذي يُسقى من الآبار بواسطة النضح ونحوه. {يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ} يعني: التجارة: {وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ} يعني: النبات، وتحقيق هذا أن الاكتساب على قسمين: منها: ما يكون من بطن الأرض، وهو النباتات كلها، ومنها: ما يكون من المحاولة على الأرض؛ كالتجارة، والنتاج، والاصطياد، فأمرَ اللهُ تعالى الأغنياءَ من عباده بأن يؤتوا الفقراء مما آتاهم من فضله. عن عبيدة السلماني؛ قال: سألت علياً بن أبي طالب رضي الله عنه عن قول الله: {يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ} الآية؛ فقال: نزلت هذه الآية في الزكاة المفروضة. تجب الزكاة في كل ما يخرج من الأرض مما يزرعه الآدمي من فواكه وغير فواكه، واستدلوا بعموم قول الله تعالى: {يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الأَرْضِ} [البقرة: 267]، وبقوله صلّى الله عليه وسلّم: «فيما سقت السماء العشر». عموم هذه الآية يوجب الصدقة في سائر الأموال; لأن قوله تعالى: {يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ وَلَا تَيَمَّمُوا الْخَبِيثَ مِنْهُ تُنْفِقُونَ وَلَسْتُمْ بِآخِذِيهِ إِلَّا أَنْ تُغْمِضُوا فِيهِ وَاعْلَمُوا أَنَّ اللَّهَ غَنِيٌّ حَمِيدٌ (267)} ينتظمها. الْأَصْلُ فِي وُجُوبِ الزَّكَاةِ فِي الثِّمَارِ الْكِتَابُ وَالسُّنَّةُ وَالْإِجْمَاعُ، فَأَمَّا الْكِتَابُ فَقَوْلُهُ تَعَالَى: يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الْأَرْضِ، [الْبَقَرَةِ: 267]، فَأَوْجَبَ بِأَمْرِهِ الْإِنْفَاقَ مِمَّا أَخْرَجَ مِنَ الْأَرْضِ، وَالثِّمَارُ خَارِجَةٌ مِنْهَا. ظاهر الآية يدل على وجوب الزكاة في كلِّ مالٍ يكتسبه الإنسان، فيدخل فيه: زكاة التجارة، وزكاة الذهب والفضة والعملات، وزكاة الزروع والثمار، وزكاة النَّعم، لأن ذلك مما يوصف بأنه مُكتسَب. الأصل في وجوب زَكَاةِ الحُبُوبِ وَالثِّمَار، قول الله تبارك وتعالى: {يَاأَيُّهَا الَّذِينَ آمَنُوا أَنْفِقُوا مِنْ طَيِّبَاتِ مَا كَسَبْتُمْ وَمِمَّا أَخْرَجْنَا لَكُمْ مِنَ الأَرْضِ} [البقرة: 267]. هذه الآية أصل في باب زكاة الزروع والثمار، كما في قَوْله تَعَالَى: {وَآتُوا حَقَّهُ يَوْمَ حَصَادِهِ} [الأنعام: 141]. هذه الآية أصل في بَاب صَدَقَةِ الْكَسْبِ وَالتِّجَارَةِ.
