السؤال :
كيف تقوم المصارف الإسلاميَّة باستثمار أموالها؟
الفتوى :
الأساسُ الذي انبنَى عليه البنكُ الإسلاميُّ هو شركة المضارَبة الإسلاميَّة، بأن يأخذ أموال المسلمين كمضارِب أو كعامل، ثُمَّ يُتاجر أو يصنع أو يزرع أو يعمل أيَّ عملٍ يقرُّه الإسلام، وناتج الرِّبح يقسَّم بين البنك وبين المودعين بنسبة متَّفق عليها.
تتَّجه المصارف الإسلاميَّة إلى بيع المرابحة في حالة ما إذا كان العميل لا يملك ثمن البضاعة، فإذا اطمأنَّت إلى مركزه ووجدتِ الضمانات الكافيَة إذا باعت، هنا تأتي إلى بيوع المرابحة، على أساس أنها تشتري وتحوز بعد أن مَلَكَتْ، ثم بعد هذا تبيع.
ولو أنَّ مصرفًا باع قبل المِلْك أو قبل الحيازة فتصرُّفه غيرُ إسلاميٍّ.
أحيانًا تتوسَّع المصارف أكثر، ويكون عندها خبرة أكثر، وعندها مخازن وخبراء فنِّيون في كذا، فهنا يمكن أن تقوم بدورها بنشاط تجاري أو صناعي أو زراعي، ثمَّ ما يتحقَّق من أرباح يقسَّم بينهم وبين المستثمرين أصحاب رؤوس الأموال.
نذكر هنا على سبيل المثال: أنَّ مؤسَّسةً منَ المؤسَّسات الإسلاميَّة التي أُنشئت استصلحت خمسمائة ألف فدان في بلد ما، لو أردنا ألاَّ نلجأ إلى مصرِف إسلامي أو شركة إسلاميَّة؛ بل إلى بنوك ربويَّة لنطلب منها أن نستصلح الأرض؟ إنَّها لا يمكن أن تقرض بفائدة لاستصلاح الأرض؛ إلاَّ إذا كان عندها ضمانات كافيَّة؛ لأنَّ هذه البنوك الربويَّة لا شأن لها بالأرض ولا باستصلاحها ولا بزراعتها، وإنَّما هي - كما عرفنا عند الاقتصاديين - تتاجر في الدِّيون؛ فهي لا تتاجر في أرض ولا في زرع ولا في استصلاح، وإنما هي تتاجر في الدُّيون وفي النُّقود، فهي تقترض بربا وتُقرِض بربا، إذًا فلو أنَّ بنكًا ربويًّا أراد أن يدخل في هذا لدخل كمُقرِضٍ ربويٍّ، ولذلك فإنَّه لا يدخل في مثل هذه المشروعات.
وننظُر إلى الشَّركة الإسلاميَّة التي قامت بهذا وإلى نتيجةِ عمَلِها، عندما تأتي في مساحات شاسعة، تصلح خمسمائة ألف فدان، وتزرع خمسمائة ألف فدان، العائد هنا يعود على مَنْ؟.
