من الذي يتحمل المسؤولية في حالة البيع (مرابحة للآمر بالشراء) عند حال تلف جزء من البضاعة؟
هل يتحملها المصرف؟ أو يتحملها الزبون (الآمر بالشراء)؟ وذلك في حالة تلف جزء من البضاعة للعميل (الآمر بالشراء)، وذلك بعد أن نُقِلَت البضاعة من المرافئ إلى مخازن المصرف.
مَن يتحمل هذه المسؤولية؟
هل هو مَن اشترى، وفي حالة (المرابحة للآمر بالشراء) المشتري هو (المصرف) الذي اشترى من المورد (المستورد، البائع الأصلي)؟.
اعتُبر البنك هو المستورد من المورد (المصدر الأصلي)، وتنتقل البضاعة إليه، وتدخل في حيازته.
فإذا تلف شيء منها؛ فهو يتحمل مسؤوليتها.
وإذا سَلِمَت ـ وهو الأغلب والأعم ـ فإنه يتصل بالزبون (العميل)، ويقول له: وصلت البضاعة التي كنت ترغب بشرائها، ووعدتني بأن تشتريها مني، فتفضل ونفذ وعدك.
عند ذلك يتم عقد بيع جديد من المصرف الذي ملك بعد أن اشترى من مكان بعيد، وراح يبيع لمن هو داخل البلد.
اشترى برأس مال نقدي، وأضاف نسبة مرابحة على هذا الزبون الذي فضَّل أن يشتري البضاعة بالتقسيط؛ كونه لا يملك السيولة الكافية واللازمة، ولا يستطيع الشراء مباشرة.
إذاً؛ تحمل جزء من البضاعة إذا تلف يكون على المشتري الأول، (البنك، المصرف) وليس المشتري الأخير (العميل، الزبون).
