السؤال :

لا أريد أن ألد لأن أعصابي لا تتحمل أن أربي أطفالا وأراعي فيهم أوامر الله، وهذا عن خبرة في تعاملي مع أطفال العائلة، فهل حرام أن أشترط عدم الإنجاب في الزواج؟
الفتوى :
الفَتْوَى
قال الله تعالى: وَاللهُ جَعَلَ لَكُم مِّنْ أَنفُسِكُمْ أَزْوَاجًا وَجَعَلَ لَكُم مِّنْ أَزْوَاجِكُم بَنِينَ وحفدة.. {النحل:72} ، فهذه الآية فيها يمتن الله تعالى علينا بنعمة الزوجية التي تكون سبباً لنعمة أخرى وهي البنون والحفدة، وقد أمر الشرع بزواج الودود الولود.
فالولد مقصود شرعاً ومطلوب طبعاً ومرغب في النكاح لأجله، فأي شرط يعود على هذا المقصود بالإبطال فهو باطل، وعليه فليس من حقك أن تشترطي على الزوج عدم الإنجاب في المستقبل وإن اشترطته فلا يلزمه الوفاء به والنكاح صحيح.
جاء في متن الإقناع وهو أحد كتب الحنابلة: إذا شرطا الخيار في النكاح أو في المهر ... أو يشترط أن يعزل عنها.. بطل الشرط وصح العقد. وجاء مثل هذا الكلام في المغني لابن قدامة.
والتخوفات التي تحملك على طلب هذا عبارة عن اضطرابات نفسانية قبل الزواج، وإذا أنعم الله عليك بالولد فسيختلف الأمر لما جعل الله في قلب الأم من المحبة والمودة للولد.
