ـ[عالمي الجليل: أريد منك فتوى ضرورية وهي: لدي صديق يعمل في شركة رحلات، وقد تعرض بيته للسرقة وكان داخل البيت فواتير وأموال تابعة للشركة وقد سرقت، فترك العمل للبحث عن السارق، ولكن حصلت مشاكل بسبب ترك العمل، فهو الآن في مشاكل مع رئيس القسم الذي يشتغل فيه، فترك القسم وذهب لقسم آخر لكن المدير قدم مذكرة للمدير العام في صديقي هذا، ويريد الآن من صديقي أن يترك العمل، فصديقي في حالة ضيق بسببه، ويريد ضرب رئيس القسم بسبب المذكرة التي كتبت فيه.

[الفَتْوَى]
قبل الجواب عما سألت عنه نريد أولا أن ننبه إلى أن تلك الأموال والفواتير إن كانت محفوظة في بيت صديقك بإذن من صاحب الشركة التي يعمل بها أو ممن فوضه بإدارتها فإن يده عليها يد أمانة ولا ضمان عليه إذا سرقت من عنده إلا إذا كان متعديا أو مفرطا، وانظر الفتوى رقم: 70056، وإن كانت عنده بدون إذن فهو ضامن لما سرق مطلقا إلا أن يحله صاحب المال.
ولقد أخطأ صديقك عندما تغيب عن العمل للبحث عن السارق دون إذن؛ لأنه في وقت العمل الرسمي للشركة أجير لصاحب العمل ليس له الاشتغال بغير الأعمال المنوطة به، وانظر الفتوى رقم: 117118.
كما أنه ليس له ضرب رئيسه لمجرد أنه قدم فيه شكوى للمدير العام؛ لأن هذه الشكوى بمثابة دعوى، ولا بد من حكومة للفصل في أمره وبيان ما يلزمه تجاه الشركة، وانظر الفتوى رقم: 74568.
وإن وقع عليه ظلم، فإن استطاع أن يرفعه عن نفسه بالتحاكم إلى ولاة الأمر وأصحاب الشأن فعل، وإن عجز فليصبر، وعند الله تجتمع الخصوم.
