الاعتكاف

يفسد الاعتكاف ما يلي:
الأول - الجماع ودواعيه.
الثاني - الخروج من المسجد.
أ - الخروج لقضاء الحاجة والوضوء والغسل الواجب.
ب - الخروج للأكل والشّرب.
ت - الخروج لغسل الجمعة والعيد.
ث - الخروج لصلاة الجمعة.
ج -الخروج لعيادة المرضى وصلاة الجنازة.
ح - الخروج في حالة النّسيان.
خ - الخروج لأداء الشّهادة.
د - الخروج لمعالجة مرضه.
ذ - الخروج لانهدام المسجد.
ر - الخروج حالة الإكراه.
ز - خروج المعتكف بغير عذرٍ.
س - حدّ الخروج من المسجد.
ش - ما يعتبر من المسجد وما لا يعتبر:
اتّفق الفقهاء على أنّ المراد بالمسجد الّذي يصحّ فيه الاعتكاف، ما كان بناءً معدّاً للصّلاة فيه.
أمّا رحبة المسجد، وهي ساحته الّتي زيدت بالقرب من المسجد لتوسعته، وكانت محجّراً عليها، فالّذي يفهم من كلام الحنفيّة والمالكيّة والحنابلة في الصّحيح من المذهب أنّها ليست من المسجد، ومقابل الصّحيح عندهم أنّها من المسجد، وجمع أبو يعلى بين الرّوايتين بأنّ الرّحبة المحوطة وعليها بابٌ هي من المسجد.
وذهب الشّافعيّة إلى أنّ رحبة المسجد من المسجد، فلو اعتكف فيها صحّ اعتكافه.
وأمّا سطح المسجد فقد قال ابن قدامة: يجوز للمعتكف صعود سطح المسجد، ولا نعلم فيه خلافاً.
أمّا المنارة فإن كانت في المسجد أو بابها فيه فهي من المسجد عند الحنفيّة والشّافعيّة والحنابلة.
وإن كان بابها خارج المسجد أو في رحبته فهي منه، ويصحّ فيها الاعتكاف عند الشّافعيّة.
وإن كان بابها خارج المسجد فيجوز أذان المعتكف فيها، سواءٌ أكان مؤذّناً أم غيره عند الحنفيّة، وأمّا عند الشّافعيّة فقد فرّقوا بين المؤذّن الرّاتب وغيره، فيجوز للرّاتب الأذان فيها وهو معتكفٌ دون غيره، قال النّوويّ: وهو الأصحّ([1] ) .
