الحج
مطلب: تعريف الحج:
مطلب: الحكم التكليفي للحج:
الحج فرض عين على كل مكلف مستطيع، في العمر مرة.
وهو ركن من أركان الإسلام.
ثبتت فرضيته بالكتاب والسنة والإجماع.
أ - أما الكتاب:
فقد قال الله تعالى: {وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً وَمَنْ كَفَرَ فَإِنَّ اللَّهَ غَنِيٌّ عَنِ الْعَالَمِينَ} [آل عمران: 97].
فهذه الآية نص في إثبات الفرضية، حيث عبر القرآن بصيغة {وَلِلَّهِ عَلَى النَّاسِ} وهي صيغة إلزام وإيجاب، وذلك دليل الفرضية، بل إننا نجد القرآن يؤكد تلك الفرضية تأكيداً قوياً في قوله تعالى: {وَمَنْ كَفَرَ فَإِنَّ اللَّهَ غَنِيٌّ عَنِ الْعَالَمِينَ} فإنه جعل مقابل الفرض الكفر، فأشعر بهذا السياق أن ترك الحج ليس من شأن المسلم، وإنما هو شأن غير المسلم.
وأما السنة فمنها:
حديث ابن عمر عن النبي صلى الله عليه وسلم قال: "بُنِيَ الإِسْلاَمُ عَلَى خَمْسٍ: شَهَادَةِ أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ وَأَنَّ مُحَمَّدًا رَسُول اللَّهِ، وَإِقَامِ الصَّلاَةِ، وَإِيتَاءِ الزَّكَاةِ، وَصِيَامِ رَمَضَانَ، وَالْحَجِّ"([1] .
وعن أبي هريرة، قال: خطبنا رسول الله صلى الله عليه وسلم فقال: "أَيُّهَا النَّاسُ قَدْ فَرَضَ اللَّهُ عَلَيْكُمُ الْحَجَّ فَحُجُّوا"، فقال رجل: أكل عام يا رسول الله؟ فسكت، حتى قالها ثلاثاً، فقال رسول الله صلى الله عليه وسلم: "لَوْ قُلْتُ نَعَمْ لَوَجَبَتْ وَلَمَا اسْتَطَعْتُمْ..."([2] .
ج - وأما الإجماع:
فقد أجمعت الأمة على وجوب الحج في العمر مرة على المستطيع.
وهو من الأمور المعلومة من الدين بالضرورة؛ يكفر جاحده([3] .
