مطلب: تعريف الحج.

شرطان هما: الزوج أو المحرم، وعدم العدة.
أولاً - الزوج أو المحرم الأمين:
يشترط أن يصحب المرأة في سفر الحج زوجها أو محرم منها، إذا كانت المسافة بينها وبين مكة ثلاثة أيام، وهي مسيرة القصر في السفر، وإلى هذا ذهب الحنفية والحنابلة([1] .
واستدلوا بحديث ابن عمر أن رسول الله صلى الله عليه وسلم قال: "لاَ تُسَافِرُ الْمَرْأَةُ ثَلاَثًا إِلاَّ وَمَعَهَا ذُو مَحْرَمٍ"([2] .
وتوسع الشافعية والمالكية فسوغوا الاستبدال بالمحرم([3] :
ذهب الشافعية إلى أنها إن وجدت نسوة ثقات؛ اثنتين فأكثر تأمن معهن على نفسها، كفى ذلك بدلاً عن المحرم، أو الزوج بالنسبة لوجوب حجة الإسلام على المرأة.
وزاد المالكية توسعاً فقالوا: المرأة إذا لم تجد المحرم أو الزوج ولو بأجرة تسافر لحج الفرض أو النذر مع الرفقة المأمونة، بشرط أن تكون المرأة بنفسها هي مأمونة.
أما حج النفل فلا يجوز للمرأة السفر له إلا مع الزوج أو المحرم فحسب؛ اتفاقاً، ولا يجوز لها السفر بغيرهما، بل تأثم به.
ثانياً - عدم العدة:
يشترط ألا تكون المرأة معتدة عن طلاق أو وفاة مدة إمكان السير للحج، وهو شرط متفق عليه([4] .
والدليل على ذلك أن الله تعالى نهى المعتدات عن الخروج من بيوتهن؛ بقوله تعالى: {لاَ تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلاَ يَخْرُجْنَ إِلاَّ أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} [الطلاق: 1].
والحج يمكن أداؤه في وقت آخر، فلا تُلْزَم بأدائه وهي في العدة.
وقد عمم الحنفية هذا الشرط لكل معتدة سواء كانت عدتها من طلاق بائن أو رجعي، أو وفاة، أو فسخ نكاح. ونحو ذلك عند المالكية([5] .
وفصل الحنابلة فقالوا: لا تخرج المرأة إلى الحج في عدة الوفاة، ولها أن تخرج إليه في عدة الطلاق المبتوت؛ وذلك لأن لزوم البيت فيه واجب في عدة الوفاة، وقدم على الحج؛ لأنه يفوت، والطلاق المبتوت لا يجب فيه ذلك.
وأما عدة الرجعية فالمرأة فيه بمنزلتها في طلب النكاح، لأنها زوجة([6] .
