مطلب: تعريف الحج.

لو خالفت المرأة وخرجت للحج في العدة صح حجها، وكانت آثمة.
إن خرجت من بلدها للحج وطرأت عليها العدة ففيها تفصيل:
عند الحنفية: إن طلقها زوجها طلاقاً رجعياً تبعت زوجها، رجع أو مضى، لم تفارقه، والأفضل أن يراجعها. وإن كان بائناً أو مات عنها فإن كان إلى منزلها أقل من مدة السفر وإلى مكة مدة سفر فإنه يجب أن تعود إلى منزلها، وإن كانت إلى مكة أقل مضت إلى مكة، وإن كانت إلى الجانبين أقل من مدة السفر فهي بالخيار إن شاءت مضت، وإن شاءت رجعت إلى منزلها سواء كانت في المصر أو غيره، وسواء كان معها محرم أو لا، إلا أن الرجوع أولى. وإن كان من الجانبين مدة سفر فإن كانت في المصر فليس لها أن تخرج بغير محرم بلا خلاف، وإن كان ذلك في مفازة أو قرية لا تأمن على نفسها ومالها فلها أن تمضي إلى موضع الأمن ثم لا تخرج منه حتى تمضي عدتها([1] .
وعند المالكية: إذا خرجت مع زوجها لحج الفريضة فمات أو طلقها في ثلاثة أيام أو نحوها أنها ترجع إذا وجدت ثقة ذا محرم، أو ناساً لا بأس بهم. وإن بعدت أو كانت أحرمت أو أحرمت بعد الطلاق أو الموت، وسواء أحرمت بفرض أو نفل أو لم تجد رفقة ترجع معهم فإنها تمضي([2] .
وعند الحنابلة: إذا خرجت للحج فتوفي زوجها وهي قريبة رجعت لتعتد في منزلها، وإن تباعدت مضت في سفرها([3] .
