وتفصيل ذلك فيما يلي:
مواقيت الإحرام
الميقات الزماني
الميقات المكاني
الميقات المكاني ينقسم قسمين:
ميقات مكاني للإحرام بالحج، وميقات مكاني للإحرام بالعمرة.
أولاً: الميقات المكاني للإحرام بالحج:
يختلف الميقات المكاني للإحرام بالحج باختلاف مواقع الناس، فإنهم في حق المواقيت المكانية على أربعة أصناف، وهي:
الصنف الأول: الآفاقي.
الصنف الثاني: الميقاتي.
الصنف الثالث: الحرمي.
الصنف الرابع: المكي، ويشترك مع الحرمي في أكثر من وجه، فيكونان مسألة واحدة.
ثم صنف خامس: هو من تغير مكانه، ما ميقاته؟.
ميقات الآفاقي: وهو من منزله خارج منطقة المواقيت.
اتفق العلماء على تقرير الأماكن الآتية مواقيت لأهل الآفاق المقابلة لها، وهذه الأماكن هي:
أ - ذو الحليفة: ميقات أهل المدينة، ومن مر بها من غير أهلها. وتسمى الآن (آبار علي).
ب - الجحفة: ميقات أهل الشام بحراً، ومن جاء من قبلها من مصر، والمغرب. ويُحْرِم الحجاج من (رابغ)، وتقع قبل الجحفة، إلى جهة البحر، فالمحرم من (رابغ) محرم قبل الميقات.
ج - قرن المنازل: ميقات أهل نجد، و(قرن) جبل مطل على عرفات. وهو أقرب المواقيت إلى مكة، وتسمى الآن (السيل).
د - يلملم: ميقات باقي أهل اليمن وتهامة، والهند بحراً. وهو جبل من جبال تهامة، جنوب مكة.
هـ - ذات عرق: ميقات أهل العراق، وسائر أهل المشرق.
أدلة تحديد مواقيت الآفاق:
والدليل على تحديدها مواقيت للإحرام السنة والإجماع:
أ - أما السنة فأحاديث كثيرة، نذكر منها: حديث ابنِ عباس رضي الله عنهما قال: إن رسول الله صلى الله عليه وسلم وَقَّت لأهل المدينة ذا الحليفة، ولأهل الشام الجحفة، ولأهل نجد قرن المنازل، ولأهل اليمن يلملم. هن لهن؛ ولمن أتى عليهن من غير أهلهن، ممن أراد الحج والعمرة. ومن كان دون ذلك فمن حيث أنشأ، حتى أهل مكة من مكة([1] .
وحديث عبد الله بنِ عمر رضي الله عنهما أن رسول الله صلى الله عليه وسلم قال: يُهْلُّ أهل المدينة من ذي الحليفة، وأهل الشام من الجحفة، وأهل نجد من قرن. قال ابن عمر: وبلغني أن رسول الله صلى الله عليه وسلم قال: ويهل أهل اليمن من يلملم([2] .
فهذه نصوص في المواقيت عدا ذات عرق.
وقد اختلف في دليل توقيت ذات عرق هل وقت بالنص أم بالاجتهاد والإجماع. فقال الشافعي ومالك ثبت باجتهاد عمر رضي الله عنه وأقره الصحابة، فكان إجماعاً.
وصحح الحنفية والحنابلة وجمهور الشافعية أن توقيت ذات عرق منصوص عليه من النبي صلى الله عليه وسلم وأن عمر رضي الله عنه لم يبلغه تحديد النبي صلى الله عليه وسلم فحدده باجتهاده فوافق النص([3] .
ب - وأما دلالة الإجماع على هذه المواقيت فقال ابن المنذر: أجمع العلماء على هذه المواقيت([4] .
