أدلة تحريم الصيد:
وقد ثبت تحريم الصيد على المُحْرِم بالكتاب والسنة والإجماع:
أما الكتاب:
فقوله تعالى: {يَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ} [المائدة: 95]،
وقال عزَّ مِن قائل: {وَحُرِّمَ عَلَيْكُمْ صَيْدُ الْبَرِّ مَا دُمْتُمْ حُرُمًا} [المائدة: 96].
وكل منهما نص قاطع في الموضوع.
وأما السنة فمنها:
حديث أبي قتادة حين أحرم أصحابه ولم يُحْرِم، ورأى حمار وحش. وفي الحديث:
فأسرجتُ فَرَسِي، وأخذتُ رمحي، ثم ركبتُ، فسقط مني سوطي، فقلت لأصحابي - وكانوا مُحْرِمين - ناولوني السوط. فقالوا: والله لا نعينك عليه بشيء، فنزلتُ، فتناولتُه، ثم ركبت. وفي رواية أخرى: فنزلوا، فأكلوا من لحمها، وقالوا: أنأكل لحم صيد ونحن محرمون؟ فحملنا ما بقي من لحم الأتان، فلما أتوا رسول الله صلى الله عليه وسلم قالوا: يا رسول الله إنا كنا أحرمنا، وقد كان أبو قتادة لم يُحْرِم، فرأينا حمر وحش، فحمل عليها أبو قتادة فعَقَرَ منها أتاناً، فنزلنا، فأكلنا من لحمها، ثم قلنا: أنأكل لحم صيد ونحن محرمون؟ فحملنا ما بقي من لحمها. قال: " أَمِنْكُمْ أَحَدٌ أَمَرَهُ أَنْ يَحْمِل عَلَيْهَا أَوْ أَشَارَ إِلَيْهَا"؟ قالوا: لا، قال: " فَكُلُوا مَا بَقِيَ مِنْ لَحْمِهَا"([1] .
وأما الإجماع فقد حكاه النووي وابن قدامة، كما ذُكِرَ إجماع أهل العلم على وجوب الجزاء بقتل الصيد([2] .
