التحلل من الإحرام
المراد بالتحلل هنا: الخروج من الإحرام، وحِلُّ ما كان محظوراً عليه، وهو مُحْرِم.
والتحلل قسمان: تحلل أصغر، وتحلل أكبر
التحلل الأصغر:
يكون التحلل الأصغر بفعل أمرين من ثلاثة: رمي جمرة العقبة، والنحر، والحلق أو التقصير.
ويحل بهذا التحلل: لُبْسُ الثياب، وكلُّ شيء
ما عدا النساءِ؛ بالإجماع،
وما عدا الطيبِ عند البعض،
وماعدا الصيدِ عند المالكية.
والأصل في هذا الخلاف:
ما ورد عن السيدة عائشة رضي الله عنها أنها ضمخت رسول الله صلى الله عليه وسلم بالمسك قبل أن يطوف طواف الإفاضة.
ولما أخرجه مالك في الموطأ عن عمر رضي الله عنه، أنه خطب الناس بعرفة، وعلمهم أمر الحج، وقال لهم فيما قال: إِذَا جِئْتُمْ مِنًى فَمَنْ رَمَى الْجَمْرَةَ فَقَدْ حَلَّ لَهُ مَا حَرُمَ عَلَى الْحَاجِّ إِلَّا النِّسَاءَ وَالطِّيبَ، لَا يَمَسَّ أَحَدٌ نِسَاءً وَلَا طِيبًا حَتَّى يَطُوفَ بِالْبَيْتِ([1] .
وأما ما ذهب إليه مالك من تحريم الصيد كذلك فإنه أخذ بعموم قوله تعالى: {لاَ تَقْتُلُوا الصَّيْدَ وَأَنْتُمْ حُرُمٌ} [المائدة: 95]، ووجه الاستدلال بالآية أن الحاج يعتبر محرماً ما لم يطف طواف الإفاضة.
التحلل الأكبر:
هو التحلل الذي تحل به جميع محظورات الإحرام دون استثناء.
ويبدأ الوقت الذي تصح أفعال التحلل الأكبر فيه:
عند الحنفية والمالكية من طلوع فجر يوم النحر،
وعند الشافعية والحنابلة من منتصف ليلة النحر، وذلك تابع لاختلافهم فيما يحصل به التحلل الأكبر.
أما نهاية وقته فبحسب ما يتحلل به، فهو لا ينتهي إلا بفعل ما يتحلل به عند الحنفية والمالكية؛ لأنه لا يفوت، وهو الطواف.
وأما عند الشافعية والحنابلة فكذلك إن توقف التحلل الأكبر على الطواف أو الحلق، أو السعي.
أما الرمي فإنه مؤقت بغروب شمس آخر أيام التشريق، فإذا توقف عليه التحلل، ولم يرم حتى آخر أيام التشريق، فات وقت الرمي بالكلية، فيحل عند الحنابلة بمجرد فوات الوقت، وإن بقي عليه الفداء مقابل ذلك. وهذا قول عند الشافعية، لكن الأصح عندهم أنه بفوات وقت الرمي ينتقل التحلل إلى كفارته، فلا يَحِل حتى يؤديها.
ما يحصل به التحلل الأكبر:
يحصل التحلل الأكبر عند الحنفية والمالكية بطواف الإفاضة، بشرط الحلق.
وعند الشافعية والحنابلة يحصل التحلل الأكبر باستكمال أفعال التحلل التي ذكرناها: ثلاثة على القول بأن الحلق نسك، واثنان على القول الآخر غير المشهور أنه ليس بنسك.
ثم إذا حصل التحلل الأكبر في اليوم الأول لجوازه مثلاً فلا يعني انتهاء كل أعمال الحج، بل يجب عليه الإتيان بها، وإن كان حلالاً (أي: غير مُحْرِمٍ).
