كفارات محظورات الإحرام.
كفارات محظورات الترفه:
ويتناول كفارة محظورات اللُّبْسِ، وتغطية الرأس، والادهان، والتطيب، وحلق الشعر أو إزالة قطعة من شعر الرأس أو غيره، وَقَلْمِ الظُّفُرِ.
وتفصيل المذاهب في كل محظور من محظورات الترفه فيما يلي:
أولاً: اللباس:
ثانياً: التطيب:
يجب الفداء عند جمهور الفقهاء([1] لأي تطيُّب، دون تقييد بأن يطيب عضواً كاملاً، أو مقداراً من الثوب معيناً.
وفرق الحنفية بين تطيُّب وتطيُّب، وفصَّلوا: أما في البدن فقالوا: تجب شاة إنْ طَيَّب المحرم عضواً كاملاً؛ مثل الرأس، واليد، والساق، أو ما يبلغ عضواً كاملاً.
والبدن كله كعضو واحد إن اتحد مجلس التطيب، وأما إن تفرق المجلس فلكل طيب كفارة، وتجب إزالة الطيب؛ فلو ذبح ولم يزله لزمه دم آخر.
ووجه وجوب الشاة: أن الجناية تتكامل بتكامل الارتفاق، وذلك في العضو الكامل، فيترتب كمال الموجب.
وإن طيَّب أقل من عضو فعليه الصدقة لقصور الجناية، إلا أن يكون الطيب كثيراً؛ فعليه دم.
ولم يشرط الحنفية استمرار الطيب لوجوب الجزاء، بل يجب بمجرد التطيب([2] .
وأما تطييب الثوب: فيجب فيه الدم عند الحنفية بشرطين:
أولهما: أن يكون كثيراً، وهو ما يصلح أن يغطي مساحة تزيد على شبر في شبر.
والثاني: أن يستمر نهاراً، أو ليلة.
فإن اختل أحد الشرطين وجبت الصدقة.
وإن اختل الشرطان معاً وجب التصدق بقبضة من قمح([3] .
