الهدي

مكان ذبح الهدي:
اتفق الفقهاء على أن دماء الهدي - عدا الإحصار - يختص جواز إراقتها بالحرم، ولا يجوز ذبح شيء منها خارجه.
لقوله تعالى في جزاء الصيد: {هَدْيًا بَالِغَ الْكَعْبَةِ} [المائدة: 95]، وقوله تعالى: {ثُمَّ مَحِلُّهَا إِلَى الْبَيْتِ الْعَتِيقِ} [الحج: 33]، ولقوله صلى الله عليه وسلم: "نَحَرْتُ هَاهُنَا، وَمِنًى كُلُّهَا مَنْحَرٌ، فَانْحَرُوا فِي رِحَالِكُمْ"( [1] ) ، وقوله صلى الله عليه وسلم: "كُل فِجَاجِ مَكَّةَ طَرِيقٌ وَمَنْحَرٌ"( [2] ) .
ونص الحنفية على أن مكان ذبح الهدايا بما فيها دم المحصَر: الحرم، فلا يجوز ذبح الهدايا إلا في الحرم.
واحتجوا بقول الله تعالى: {وَلاَ تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ} [البقرة: 196]، ولو كان كل موضع محلاً للذبح لم يكن لذكر المحل فائدة.
وأفضل بقاع الحرم للنحر( [3] ) عند الشافعية والحنابلة في حق الحاج: منى، وفي حق المعتمر: مكة.
وعند الحنفية: أن السنة في الهدايا في أيام النحر منى، وفي غير أيام النحر، الأَوْلَى أن يكون الذبح بمكة.
وعند المالكية: أن الأفضل في حق الحاج منى عند الجمرة الأولى، وأن الأفضل في حق المعتمر عند المروة.
