أولاً - شروط وجوب الإحجاج.
ثانياً: شروط النائب عن غيره في الحج:
اشترط الشافعية والحنابلة لإجزاء الحج الفرض عن الأصيل أن يكون النائب قد حَجَّ حَجَّة الإسلام عن نفسه أولاً، وإلا كانت الحَجَّة عن نفسه، ولم تجزئ عن الأصيل( [1] ) .
واكتفى الحنفية والمالكية بأهلية المأمور لصحة الحج، بأن يكون مسلماً عاقلاً، فأجازوا أن يكون المأمور لم يحج عن نفسه حجة الإسلام (وهو المسمى صرورة)( [2] ) .
استدل الأولون: بحديث ابن عباس رضي الله عنهما أن النبي صلى الله عليه وسلم سمع رجلاً يقول: لبيك عن شبرمة. قال: "مَنْ شُبْرُمَةُ"؟ قال: أخ لي، أو قريب لي. قال: "حَجَجْتَ عَنْ نَفْسِكَ"؟ قال: لا. قال: "حُجَّ عَنْ نَفْسِكَ، ثُمَّ حُجَّ عَنْ شُبْرُمَةَ"( [3] ) .
واستدل الحنفية بإطلاق حديث الخثعمية السابق، فإنه صلى الله عليه وسلم قال لها: "حُجِّي عَنْ أَبِيكِ"( [4] ) ، من غير استخبارها عن حجها لنفسها قبل ذلك، وتركُ الاستفصالِ يَتَنَزَّل منزلة عموم المقال.
