الخطبة، والوعد بالزواج، وقراءة الفاتحة، وقبض المهر، وقبول الهدية: لا تكون زواج اً.
الخطبة من مقدمات عقد الزواج.
معناها والتّعريف بها.
حكمة الخطبة.
الحكم التّكليفيّ.
أوّلاً: حكم الخطبة بالنّظر إلى حال المرأة.
ثانياً: الخطبة على الخطبة.
ثالثاً: نظر الخاطب إلى المخطوبة.
رابعاً: ذكر عيوب الخاطب.
خامساً: الخُطبة قبل الخِطبة:
يندب للخاطب أو نائبه تقديم خُطبة قبل الخِطبة؛ للحديث: " كُل أَمْرٍ ذِي بَالٍ لاَ يُبْدَأُ فِيهِ بِحَمْدِ اللَّهِ فَهُوَ أَقْطَعُ" ([1] ، أي عن البركة.
فيبدأ بالحمد والثّناء على اللّه تعالى، ثمّ بالصّلاة على رسول اللّه صلى الله عليه وسلم، ثمّ يوصي بالتّقوى، ثمّ يقول: جئتكم خاطباً كريمتكم.
وإن كان وكيلاً قال: جاءكم موكّلي خاطباً كريمتكم أو فتاتكم.
ويخطب الوليّ أو نائبه كذلك ثمّ يقول: لستَ بمرغوب عنك، أو نحوه.
وتبرّك الأئمّة بما جاء عن ابن مسعود رضي الله تعالى عنه أنّ النّبيّ صلى الله عليه وسلم علّمنا خطبة الحاجة ([2] : «إِنَّ الْحَمْدَ لِلَّهِ، نَحْمَدُهُ وَنَسْتَعِينُهُ وَنَسْتَغْفِرُهُ، وَنَعُوذُ بِاللَّهِ مِنْ شُرُورِ أَنْفُسِنَا وَسَيِّئَاتِ أَعْمَالِنَا، مَنْ يَهْدِهِ اللَّهُ فَلاَ مُضِل لَهُ، وَمَنْ يُضْلِل فَلاَ هَادِيَ لَهُ، وَأَشْهَدُ أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ وَحْدَهُ لاَ شَرِيكَ لَهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ: {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ حَقَّ تُقَاتِهِ وَلاَ تَمُوتُنَّ إِلاَّ وَأَنْتُمْ مُسْلِمُونَ} [آل عمران: 102]، {يَاأَيُّهَا النَّاسُ اتَّقُوا رَبَّكُمُ الَّذِي خَلَقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَاءً وَاتَّقُوا اللَّهَ الَّذِي تَسَاءَلُونَ بِهِ وَالْأَرْحَامَ إِنَّ اللَّهَ كَانَ عَلَيْكُمْ رَقِيبًا} [النساء: 1]، {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللَّهَ وَقُولُوا قَوْلاً سَدِيداً * يُصْلِحْ لَكُمْ أَعْمَالَكُمْ وَيَغْفِرْ لَكُمْ ذُنُوبَكُمْ وَمَنْ يُطِعِ اللَّهَ وَرَسُولَهُ فَقَدْ فَازَ فَوْزًا عَظِيمًا عَظِيماً} [الأحزاب: 70 _ 71].
وكان القفّال يقول بعدها ([3] : أمّا بعد، فإنّ الأمور كلَّها بيد اللّه، يقضي فيها ما يشاء، ويحكم ما يريد، لا مؤخّر لما قدّم ولا مقدّم لما أخّر، ولا يجتمع اثنان ولا يتفرّقان إلاّ بقضاء وقدر وكتاب قد سبق، وإنّ ممّا قضى اللّه تعالى وقدّر أن خطب فلان بن فلان فلانة بنت فلان.. أقول قولي هذا وأستغفر اللّه لي ولكم أجمعين.
